Accordingly Mr Chan is suspended from the close of racing on Wednesday February 1st up to and including racing on Friday February 17th. This equates to four Central Districts race days:

Facts:
Following the running of Race 9, New World Wellington City Handicap, an Information was lodged by Mr J Oatham alleging a breach of Rule 636(1)(d) in that A Chan did not ride his mount out fully to the finish with his mount WOODBINE LADD dead-heating for 4th place with JOHNNY LINCOLN.
Rule 636(1) (d) provides:
(1) A person:
(d) being the Rider of a horse in a Race, must ride his horse out to the end of the Race if there is a reasonable chance of it running into a position for which there is prize money to be awarded or a dividend to be declared;
Mr Chan is an apprentice rider for Mr A Sharrock but as Mr Sharrock was not on course Mr Bradley assisted Mr Chan in the hearing.
At the outset Mr Chan confirmed to the Committee that he understood the charge and that he admitted the breach.
Mr Goodwin explained the incident using the head and side-on films. WOODBINE LADD was in front of the field over the final stages and Mr Chan was riding with vigour. The challengers began to go past WOODBINE LADD and 2 –3 strides short of the finishing post Mr Chan could be seen to relax his ride. Mr Goodwin said WOODBINE LADD finished in a dead heat for fourth place but if Mr Chan had ridden his mount out fully there was a strong likelihood he would have held fourth place on his own.
Mr Chan, assisted by Mr Bradley, said he believed he was still in front of JOHNNY LINCOLN at the finish and had just misjudged his position.
Submissions for Penalty:
Mr Oatham said Mr Chan had one previous breach of the same rule at Canterbury in June last year. On that occasion he was beaten a nose for second and received a four week suspension. Mr Oatham informed the Committee of a similar breach in November last year where the rider was beaten for 4th place and received a two day suspension and a $600 fine. For today’s breach the Stewards submitted that a 3 – 4 day suspension was an appropriate penalty.
Mr Bradley said it had been identified that Mr Chan dead-heated for fourth place therefore prize money had to be shared. He said the bigger roomier tracks like Canterbury and Wellington with long straights may have caused Mr Chan to misjudge the exact position of the finish post.
Mr Sharrock had advised the Stewards by phone that Mr Chan had engagements to ride at Hastings on Wednesday.
Reasons for Penalty:
In coming to a decision on penalty the Committee took into account all of the submissions presented. We turned to the Penalty Guide for Judicial Committees which provides a sliding scale for breaches of this rule dependant on which potential placing had been lost. The starting point for fourth place is a suspension of 2 weeks. An aggravating factor was that Mr Chan has breached this rule once before. Mitigating factors were his inexperience as an apprentice rider, his admission of the breach and the fact that he held fourth place albeit shared with another runner.
Balancing up all of these factors we were of the opinion that a four day suspension was an appropriate penalty. We heard that Mr Chan was a Districts rider who rode predominantly for his employer Mr Sharrock.
