Following Race 6, the Group 3 Golden Homes Thompson Handicap, an information was lodged by the Stewards alleging a breach of Rule 638(3) (b) in that "J Parkes used his whip excessively prior to the 200 meters when riding PERO".
Facts:
Mr Goodwin showed the incident which occurred just past the 400m mark. Mr Parkes was back midfield and could be seen to strike his horse approximately nine times, pause briefly and continue to use the whip three to four times. Mr Neal said the strikes after the break were not of a significant nature however Mr Parkes was clearly outside of the guidelines.
Mr Parkes said that during the race he was not aware he was riding outside of the guidelines but after seeing the video footage accepted he had got it wrong. PERO finished in 5th place.
Submissions for Penalty:
Mr Neal said Mr Parkes’ riding record showed two previous breaches in the last 12 months. He was fined $250 in August 2013 and, prior to that, $150 in December 2012. Mr Neal said this was a huge improvement for Mr Parkes who, sometime ago, had been counselled by the stewards over his whip use. His submission for penalty was a fine in the vicinity of $200 - $300. Mr Neal said Mr Parkes had gained no advantage by using the whip excessively so the fact the breach occurred in a Group 3 race was largely irrelevant.
Mr Parkes had no submissions to make on penalty.
Reasons for Penalty:
The guidelines for whip use in New Zealand are well recognised and understood by riders. Prior to the 200 metres they are only permitted to use the whip for six strides and then they must ride hands and heels for six strides. Mr Parkes used the whip approximately 14 times with only brief respite prior to the 200 metres. He readily admitted miscalculating the number of strides respite required. We have given Mr Parkes credit for the significant improvement he has made in relation to use of the whip. Taking into account his admission of the breach, his record, the severity of the breach and other recent penalties we impose a fine of $250.
