Due to the breach being admitted the charge was found to be proved.

Penalty:

Miss Chiong was fined $350.

Facts:

Following the running of Race 8 (Welcome Brisbane Lions Handicap) Information No. A4035 was filed with the Judicial Committee. The Information read that Miss K Chiong used her whip in an excessive manner in the home straight. (Miss Chiong rode the second placed horse THE BEAUT).

Rule 638(3)(b) reads:

A rider shall not strike a horse with a whip in a manner and to an extent which is unnecessary, excessive or improper.

Miss Chiong and Mrs Zimmerman said that they understood the rule, the charge and confirmed that the breach was admitted.

Submissions for Penalty:

Mr Goodwin showed the relevant film replays and said that Miss Chiong had hit her horse 13 times prior to the 200m without any respite.

Mr Whiterod said that Miss Chiong’s record showed that she had had two previous fines for excessive use of the whip; The first being on 27 July 2013 (fined $150) the second being on 21 September 2013 (fined $250). He submitted that a fine be imposed on this occasion.

Mrs Zimmerman on behalf of Miss Chiong said that Miss Chiong got over-excited as she thought she was going to win the race. She added that if she had have cuddled her mount up and had not used the whip as much her horse may have gone better. She said that they preferred a fine as opposed to a suspension.

Miss Chiong declined an invitation to comment regarding penalty.

Reasons for Penalty:

The committee took into account that the breach was admitted and that this was the third breach within 12 months. In fixing penalty the committee was also mindful of other penalties imposed for similar breaches.
