As Mr Doyle admitted the breach the charge was found to be proved.
Penalty:
Taking into account all of the submissions we fined Mr Doyle $300.00.
Facts:
Mr Neal lodged an information with the Judicial Committee alleging a breach of Rule 330 (3) (c) in that S Doyle failed to make the carded weight for CURRY UP in Race 2 and DESIGNATED DRIVER in Race 6.
This matter was put before the Judicial Committee due to it being Mr Doyle’s third charge in 120 days which placed it outside the time limits of the minor infringement scheme.
Earlier today Mr Doyle notified the Stewards that he would be 1kg overweight. Due to a lack of suitable replacement riders Mr Doyle was given permission by the Stewards to ride CURRY UP 1kg over the carded weight but he was replaced on DESIGNATED DRIVER by Mr R Hannam.
Submissions for Penalty:
Mr Goodwin produced Mr Doyle’s record under this rule which showed five breaches this year with penalties ranging from $100 - $300. He said this was not a good record by any standards however Mr Doyle had assured him that he would not be accepting any future rides at 54kgs. The stewards’ submission was for a fine of $300.
Mr Doyle told the committee that he took a lot of pride in his work and tried his hardest. He rode at 54 ½ kgs last week and believed he could make the 54kgs today. Unfortunately, despite spending substantial time in the sauna, this was not the case.
Reasons for Penalty:
Taking into account other penalties it appears that the usual step up from the minor infringement scheme is a fine of $300.
Mr Doyle’s record is an aggravating factor as is the fact that he was overweight for two horses today. Mr Hannam was a more than adequate replacement on one of the horses but CURRY UP was required to carry a kilo over.
In setting penalty the Committee took into account Mr Doyle’s admission of the breach and his firm assurance that he would not be accepting rides at weights he knew he could not realistically make. (It appears that Mr Doyle has difficulty saying “no” to trainers requesting his services.) Due to this commitment we have afforded Mr Doyle some leniency however we did say that any further overweight charges would likely be met by a period of suspension.
