Decision:

PADDY BOURKE was declared a non-runner (late scratching) with all investments on the horse being ordered to be refunded.

Facts:

Following the running of Race 6 (El Cheapo Cars 1200) Information No.A12285 was filed with the Judicial Committee. It requested a ruling as to whether PADDY BOURKE had had its chances affected due to an outside rail being on the ground.

Mr Goodwin showed the film replays and said that prior to the running of the race the rail had not fallen onto the track. He then explained that as the horses raced down the straight one end of the outside rail had fallen from its position and protruded out onto the track proper. Mr Goodwin said that PADDY BOURKE was racing close to the outside fence after being forced out by inside runners. He said that the horse then had to be steadied near the 100m by the Rider Mr O’Malley to avoid the fallen portion of rail. He added that the horse appeared to be travelling well at the time and then lost all chance when having to be eased.

Mr O’Malley said that his horse had just started to hit his straps and was finishing strongly when he had to take evasive action to avoid the fallen rail. He said that the rail was out far enough to get in his way. Mr O’Malley concluded by saying that he felt that his horse was travelling well enough at the time to have won the race.

Mrs Oulaghan and Mr Treweek agreed that the chances of PADDY BOURKE were affected due to the fallen portion of the rail.

Mr Goodwin said that PADDY BOURKE did not get a fair run due to the rail being down and that it should be declared a non-runner.

Reasons for Decision:

The Committee found that at a crucial stage of the race (approximately 100m from finish) PADDY BOURKE ran out of racing room and had to be steadied by its rider for no less than 7 strides. Prior to being steadied PADDY BOURKE was finishing strongly on the outside of the field and was travelling as well as the leading group of horses to his inside. The reason for running out of racing room was two-fold; firstly the horse had been forced out by inside runners and secondly by a portion of the outside running rail coming adrift from its proper position and falling onto the track proper prior to the field reaching that part of the track. The Committee was satisfied that on account of this occurrence PADDY BOURKE’s chances of finishing in a higher placing were materially affected.
