Mr J Parkes’ Jockeys License was suspended from the end of racing on 1 June 2013 up to and including all racing on 6 July 2013.
Charge:
Following the running of Race 7 (Echoes of Heaven@Linwood Park Premier) Information No. A3144 was filed with the Judicial Committee. The information stated “as the rider of Marotiri Miss (J Parkes) he failed to take all reasonable and permissible measures throughout the final stages to ensure his mount was given full opportunity to win the race”
Rule 636(1)(b) states:
A person being the rider of a horse in a race, must take all reasonable and permissible measures throughout the race to ensure that his horse is given full opportunity to win the race or to obtain the best possible finishing place;
Facts:
Rule 636(1)(b) was read and Mr Parkes said that he understood the rule and the charge and confirmed that he admitted the breach. In answer to a question from the chairman Mr Parkes said that he was happy for the hearing to take place on the day.
Submissions for Decision:
Mr Goodwin showed all video replays of the final stages of the race in question. He said that near the winning post Mr Parkes when racing clear in the lead stopped riding his horse out for approximately two strides, he said that prior to this occurring the Stewards had no problems with his riding. He identified the incident occurring near the 50m mark. He said that as the margin was only a nose between first and second placings it was the Stewards' opinion that the action of Mr Parkes cost his mount Marotiri Miss from winning the race. He added that Marotiri Miss did shift out off line but that this did not have a bearing on Mr Parkes stopping from riding his mount out for the two strides in question. In answer to a question from the committee Mr Goodwin said that Marotiri Miss was about one and half lengths clear when Mr Parkes stopped riding his mount out.
Mr Parkes for his part said that towards the final stages of the race his mount ran out and as she was coming to the end of her run he sat up for three strides (subsequently revised to one stride) and then resumed riding vigorously. He said that he was unsure whether his mount would have won the race if he had continued to ride out continually. In answer to a question from the committee, Mr Parkes said that he was able to recommence riding out without any problems when becoming aware that the eventual winner was making ground on his mount.

Mr Goodwin said that Mr Parkes had a clear record in so far as the rule is concerned, he said that the stewards were aware that a six week suspension is the starting point and invited the committee to consider Mr Parkes' good record and admission of the breach when assessing penalty.
Mr Parkes confirmed that his record was clear and added that he did not think that he would ever be charged for something like this and said that it will never happen again. He said that he was being honest when admitting the charge and thought that a six week suspension was too much. Mr Parkes asked that any suspension commence after the conclusion of racing on 1 June 2013.
Reasons for Penalty:
The JCA penalty guide for such a breach has a starting point of six weeks suspension. An aggravating factor was that the action of Mr Parkes in failing to ride his mount out fully to the end of the race when in a position to win, was “an inexcusable error of judgment”.
However the committee was prepared to give a discount for the admission of the breach and excellent record, and determined that an appropriate penalty was a suspension of 5 weeks.
