Facts:

Following the running of Race 7 Harcourts Thorndon Mile (Group One), an information was filed pursuant to Rule 652(2). The informant Mr Neal alleged that Mr S Autridge being the Trainer of A Touch Of Ruby failed to notify the authorities that the mare was in foal.

Rule 652(2) reads:

A Trainer shall as soon as possible as becoming aware of the pregnancy of a mare or filly in his charge, notify the Stipendiary Stewards in writing of the pregnancy, and the date of the last service, of such mare or filly.

Mr Autridge confirmed that he admitted the breach and said that he was aware of the rule, but thought that it was the responsibility of the Stallion Registrar or the Stud Master to do the notification, and not the responsibility of the Trainer.

Mr Neal said that it had been the belief of some people that when a mare becomes in foal it can improve the horse’s race day performance. For that reason the rule was introduced to enable the authorities to advise the punters of the horse’s condition, so that they could take it into account when making their selections. He added that Mr Autridge had said that A Touch Of Ruby had been served approximately 90 days ago and that he was aware that the horse had been in foal for approximately 50 days. He said that as a consequence of the Stipendiary Stewards not being advised, that the information was not able to be passed onto the punter.

Mr Autridge for his part said that he knew that the mare was in foal, but reiterated that he did not know that it was the responsibility of the trainer to advise the Stipendiary Stewards. In answer to a question from the committee Mr Autridge said that the horse had had at least five starts since being in foal. (It was noted by the committee that the horse had won at its last start at Counties on 18 January 2014). Mr Autridge added that it was no secret that the mare was in foal, and that George Simon had said so on air on a previous race day, but said that the right people (Stipendiary Stewards) had not been advised.

Submissions for Penalty:

Mr Neal said that the Stipendiary Stewards had given the matter of penalty some careful consideration, as there had not been a previous charge under Rule 652(2). He submitted that a fine between $300 - $500 would be an appropriate penalty. He added that Mr Autridge had been open and fully cooperative with the stewards.

Mr Autridge did not have any comment to make with regard to penalty except to say that everything that had been said was correct.

Reasons for Penalty:

The committee took into account that Mr Autridge admitted the breach and had cooperated fully with the stipendiary stewards. An Aggravating factor was that it was a Group One race which attracted a significant amount of betting. It is a belief in racing, that some mares do improve their race day performances when in foal, therefore it is imperative that the betting public are made aware of such a condition prior to them making their race day selections.

The committee determined that a fine in the higher range was an appropriate penalty.
