Penalty:

Mr Teeluck’s Apprentice Jockey’s Licence was suspended from the close of racing on 1 May 2015 up to and including racing on 16 May 2015 (4 days).

The 4 days being:
7 May - Hawkes Bay
9 May - Taranaki
14 May - Otaki
16 May - Manawatu

Facts:

Following the running of Race 3 (Gazley Handicap) Information No. A6806 was filed with the Judicial Committee. The Information alleged that Mr Teeluck allowed his mount to shift out in the home straight and interfere with SILVER BUBBLES (K Chiong).

Rule 638(1)(d) reads:
A rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Teeluck acknowledged that he understood the rule, the charge and confirmed that he admitted the breach.

All films were shown and Mr Goodwin said that Mr Teeluck rode his mount out with vigour for over 200m and did not stop riding at any stage. He said that Mr Teeluck had an obligation to stop riding out and straighten his mount but that he failed to do so.

Mr Smith said that he had ridden PASS IT ON in the past and that it is known as a “hanger”. He said that Mr Teeluck did not stop riding with the whip but that perhaps he thought that was the best way to straighten his horse.

Mr Teeluck said that his horse started to slowly shift out from the top of the straight and that he had all the pressure on the inside rein. He said that he should have put the stick away but that he thought he could win the race.

Submissions for Penalty:

Mr Goodwin said that Mr Teeluck’s record showed that the following suspensions due to careless riding had been imposed over a period of 12 months:
26 March 2015 - 4 days
4 November 2014 - 4 days
23 August 2014 - 4 days

He said that Mr Teeluck had ridden with vigour over some distance and that at no time did he attempt to take corrective action. He submitted that a 5 day suspension would be in order. He added that if a suspension was to be imposed that Mr Teeluck's employer Mrs Zimmerman had asked that it be started after racing on 1 May 2015.

Mr Smith on behalf of Mr Teeluck said that Mr Teeluck is a Central District rider only and that a 5 day suspension would mean that he would have to serve at least 3 weeks. He added that as Mr Teeluck is a Central District rider, any suspension imposed would be genuine days.

Reasons for Penalty:

In fixing penalty the committee took into account the admission of the breach, the riding record, the degree of carelessness exhibited (mid-range), the 5 day starting point and the submission by Mr Smith regarding the position of Mr Teeluck being a Central District rider only.

Taking all these matters into consideration the committee determined that a 4 day suspension was an appropriate penalty.
