Facts:
Following the running of Race 3 (Gazley Handicap) Information No. A2722 was filed with the Judicial Committee. The Information alleged that PASS IT ON shifted out in the home straight and interfered with the chances of SILVER BUBBLES (K Chiong).
Judge’s Placings were:

Rule 642(1) reads:
If a placed horse or its rider causes interference within the meaning of this Rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred they may place the first mentioned horse immediately after the horse interfered with.
All acknowledged that they understood the rule.
The Chair then informed the hearing that when they are invited to make their submissions, to do so in full, as there would not be any cross-examination. He advised that at the completion of the submissions of the connections concerned, the Stipendiary Steward may be asked for his view on the matter. The hearing was then advised by the Chair that due to the time factor, that when the decision was given, it would be as brief as “dismissed” or “upheld” and that a full written decision would be available on the JCA website in due course.

Miss Chiong gave her submission with the running of the films. She said that she had got pushed wider and wider all the way down the straight and that if she had not been forced wide she would have finished closer.
Mr Bothwell said that PASS IT ON was not straightened by its rider and that his horse was pushed over a considerable amount of ground, that it was put off balance and in his opinion lost about one length.
Mr Teeluck said that his horse got a bit lost early in the run home and that the other horse (SILVER BUBBLES) did not make up any ground on his horse and that if it had have been good enough it would have passed him. He added that he did dictate SILVER BUBBLES a bit.
Mr Allen said that SILVER BUBBLES’ rider did not stop riding and that it could have passed his horse at any time if it had have been going good enough.
Mr Goodwin, for the Stipendiary Stewards, said that although interference occurred, PASS IT ON was holding SILVER BUBBLES at the line.
Reasons for Decision:
The committee found that in the run down the final straight PASS IT ON did shift out several horse-widths and in doing so dictated the line of SILVER BUBBLES. During the run down the straight the committee observed that SILVER BUBBLES did not make any impression on the margin between the two horses and over the final stages PASS IT ON was travelling strongly and clearly holding off SILVER BUBBLES.
Although interference did occur, the committee was not satisfied that if such interference had not occurred that SILVER BUBBLES would have beaten PASS IT ON.
