As Mr Russell admitted the breach the charge was found to be proved.

Penalty:

Taking into account all of the submissions we fined Mr Russell the sum of $200.00.

Facts:

Following race 9, the Rydges Wellington Premier, Mr Neal lodged an information with the Judicial Committee alleging a breach of Rule 638 (3) (b) in that Mr Russell used his whip excessively prior to the 200 metres.

Mr Tidmarsh played the head, side and rear videos of the race from the home turn. He counted Mr Russell hitting his horse twelve times without the required respite prior to the 200m mark. Mr Russell finished in second place.

Submissions for Penalty:

Mr Neal told the committee Mr Russell had a clear record for the previous 12 months but today he clearly exceeded the whip guidelines. He said Mr Russell was riding vigorously contending for the finish but simply had a lapse of judgment. Mr Neal said although the breach was in the mid-range the overall level of culpability was low. The Stewards’ submission was for a monetary penalty in line with recent breaches of the same rule.

Mr Russell admitted it was a lapse of judgement on his behalf and said it was not his intention to hit his horse that many times.

Reasons for Penalty:

In coming to a decision on penalty the committee had regard to Mr Russell’s admission of the breach, the manner in which he used the whip, the number of strikes over the guidelines and his record. In our opinion Mr Russell was using the whip with some force and he did not pause at all throughout the twelve strikes. The guidelines are in place for a very good reason as excessive whip use is unnecessary and presents a negative image for racing. From a starting point of $300 we have given credit for Mr Russell’s excellent record and his admission of the breach.
