Accordingly, Ms Taiaroa's Rider's Licence is suspended for 4 riding days from 24 January 2021 to 30 January 2021 inclusive and she is fined $250.
Facts:
After the running of Race 1, the Invercargill Workingmen's Club 1200, Mr N Goodwin, Stipendiary Steward submitted an Information alleging that Ms Taiaroa committed a breach of Rule 638(1)(d) in carelessly allowing her mount "RETZENA" to shift in when not sufficiently clear of GEE STRING which was crowded and checked near the 200 metres point.
Ms Taiaroa, assisted by Ms Clapperton, admitted the charge. It is established.
Mr B Jones, Stipendiary Steward, demonstrated the incident by referring to the race films.
The Informant contended that the inward movement of Ms Taiaroa's mount was by 4 horse widths and caused a severe check to GEE STRING which had its chances extinguished. He submitted that the offence was "above mid range". RETZENA finished in 3rd place.
Submissions for Penalty:
After referring to the Guidelines, no further submissions were made by the Informant or the Respondent.
Reasons for Penalty:
The recent Guidelines provide a "starting point" of 5 days suspension and a fine of $500.
There are no aggravating factors personal to Ms Taiaroa. There exists mitigating factors which include her very good riding record, (one breach since July 2020) and is a busy and promising apprentice, eager to learn. She has no committed riding engagements in the next 7 or 10 days.
In terms of the Rule 1106(2)(a) and the Guidelines issued on 9 December 2020, and Ms Taiaroa having no engagements within that period, any suspension is required to start at the end of racing today.
After taking into account all the above factors the Committee considered that an appropriate suspension was a penalty of 4 riding days and a fine of $250.
