Decision

--

--

Following the running of the Ford Wakefield Challenge Stakes the connections of MON REVE (G. McKeon) placed fourth by the judge lodged a protest under rule 876(1) against the second horse, UDIDITAGAIN, (C. Lammas) on the grounds of interference over the final stages of the race.

--

--

The margins second to third and third to fourth were half a length and one and a quarter lengths.

--

--

Both trainers, P. McKay for MON REVE and K. Hughes for UDIDITAGAIN attended the inquiry with their riders. Mr McKeon used the front on, rear and side films of the final 100 metres to support his proposition that Mr Lammas had travelled quickly up on his inside and with a wall of horses in front of him had elected to move out and take MON REVE?S line of running when insufficiently clear. Mr McKeon believed the subsequent jostling and check to his mount cost him at least a length. Mr McKay concurred with Mr McKeon's submission and put the effect on MON REVE at closer to two lengths.

--

--

Mr Hughes believed the horses in front which were moving about under pressure put both MON REVE and UDIDITAGAIN in difficulty and that both horses finished ?on their merits' after the jostling.

--

--

Mr McCutcheon, Chief Stipendiary Steward, submitted that the head on film shows Mr Lammas sprint quickly as the horse in front, JOKERS WILD, comes to the end of its run. He believed Mr Lammas attempted to avoid JOKERS WILD but that horse shifted out causing UDIDITAGAIN to appear to catch a heel, stumble , and prop out onto MON REVE. He was firmly of the view that in the circumstances it would be unfair to uphold the protest.

--

--

Mr McKeon concluded with a firm assertion that Mr Lammas was on an outward movement before JOKERS WILD began to wilt and move about.

--

--

The Committee finds that UDIDITAGAIN did cause interference to MON REVE and take its running line, but the extenuating circumstances as described by Mr McCutcheon and evident on the head on film make it difficult to attribute fault to Mr Lammas or his horse. Events unfolded extremely quickly and we do not believe, as Mr McKeon tried to impress on us, that Mr Lammas ever intended to put himself across the running line of MON REVE. We have also taken into account the affects of the interference, the quality of MON REVE?S finish and the very clear margin of one and a quarter lengths between it and the third horse. On our analysis of those matters we do not believe the interference suffered by MON REVE affected its chances of finishing in a higher placing.

--

--

We therefore dismiss the protest and direct under rule 917(3) that the judge's placings stand. Mr McKeon's deposit is to be refunded.
