Following the running of race 3 the “New World Railway Metro Handicap” Information A4018 was filed by Stipendiary Steward Mr N Goodwin under Rule 631(2). The Information stated that G Phillips “permitted Sound Barrier and “Workingclass” to be loaded and start from incorrect barrier stalls”.
Mr Phillips signed the information admitting the breach and at the beginning of the hearing confirmed that was correct and also that he understood the rule under which he was charged.
Rule 631(2) states “Each horse shall, as far as is practicable, be started from the starting stalls corresponding to such stall position determined by NZTR in accordance with Rule 627.
Submissions for Decision:
Mr Goodwin used the head-on film of the start to identify the horses concerned. He said as a result of scratchings in the race “Workingclass” was drawn 1 and “Sound Barrier” was drawn 2. He said the film clearly showed the two horses jumping from the incorrect barriers of 2 and 1 respectively. He said the incident had been the subject of an earlier hearing when the Stewards had requested a ruling from the Committee as to whether either of the horses involved had been disadvantaged in jumping from the incorrect barrier positions. He said he had spoken to Mr Parkes, the rider of “Workingclass” who was originally drawn 2 but came into barrier 1 with the scratching of the horse originally drawn in barrier 1. Mr Goodwin said Mr Parkes said that at the start he told the starter's assistants he was drawn 1 but was told he was drawn 2 and it may well have been that is where the confusion arose.
Mr Phillips confirmed that, as is his usual practice, he called out the barrier draw to all riders in the race 2-3 minutes prior to them being loaded and again as the horses were being moved with the assistance of the starter's assistants up towards the barriers for loading. He stated he did not realise the 2 horses concerned had gone into the wrong barrier positions, accepted it was his responsibility to ensure the horses were loaded correctly and could offer no explanation as to why it had happened. To a question from the Chairman, Mr Phillips confirmed that the starter's list for the race contained the runners excluding the scratchings with their amended barrier positions.

Mr Goodwin said this was a rare occurrence and submitted that the Stipendiary Stewards believed a fine of $300 was an appropriate penalty.

Reasons for Penalty:
The head-on film of the start is very clear and shows that “Workingclass” jumped from barrier 2 instead of 1 and “Sound Barrier” jumped from 1 instead of 2. Mr Phillips, who is a very experienced Starter who works throughout the Central Districts in both the Thoroughbred and Harness codes, has been unable to explain how the incorrect loading of the two horses came about. To his credit he has quickly and without reservation accepted full responsibility for the error. Whilst the Committee ruled earlier that neither horse was disadvantaged because of the incorrect loading, the connections of all horses and those who wager on them expect them be loaded into and jump from their correct barrier positions.
The Committee is not aware of any similar breaches of this Rule in at least the last 4-5 years and believes on this occasion a fine is an appropriate penalty.
