As Mr Waddell admitted the breach the charge was found to be proved.
Penalty:
Taking into account all of these factors and looking at other recent penalties we fined Mr Waddell the sum of $600.00.
Charge:
Mr Oatham lodged an information with the Judicial Committee alleging a breach of Rule 330 (3) (c) in that J Waddell failed to make the contracted weight for LUCKY COUNTRY and SAVOUR THE MOMENT.
Facts:
Mr Oatham said Mr Waddell approached the Stewards and advised them he would not be able to make the weight on LUCKY COUNTRY in race 5 being approximately 1kg overweight. He was subsequently replaced on that horse by Ms Danielle Johnston. At the same time he also told the Stewards he would be riding half a kilo overweight on SAVOUR THE MOMENT in Race 6. Subsequent to that, the trainer of SAVOUR THE MOMENT, Mr Marsh told the Stewards he was not prepared to accept Mr Waddell riding half a kilo over.
Mr Waddell said he often rode horses for Mr Marsh half a kilo over the carded weight but on this occasion Mr Marsh was probably upset with him for not making the weight on LUCKY COUNTRY in Race 5. He told the committee he had been having a bad weight problem for the last few weeks and had incurred a few charges. Mr Oatham had sat down with him and his manager last week to talk about the situation. There was general agreement that Mr Waddell would not accept rides below 55.5 kilos however after winning on RUUD AWAKENING he believed there was pressure placed on him by the owners (who also own LUCKY COUNTRY and SAVOUR THE MOMENT) to ride at 54.5kgs. He tried his best but due to his plane being delayed today he lost valuable time in the sauna which he believes would have allowed him to get down to the correct weight.

Mr Oatham said Mr Waddell has had weight issues throughout his career but had appeared to be over his problems with a relatively clear 2012 season. In recent weeks however he has had a quick succession of charges:

Mr Oatham said he talked to Mr Waddell after the last charge in relation to what weights he takes however there had obviously been pressure put on him to accept rides today at lower weights than he could comfortably make. He said it hadn’t helped that Mr Waddell had recently been unwell however both races today were major races and it was his 4th breach in a short time. The Stewards submission was for a fine in the vicinity of $300 - $500.
Mr Waddell said he had a tough few weeks with flu going through the family. He accepted his recent record was very poor and he said he was disappointed with himself.
Reasons for Penalty:
The committee considered all of the submissions. Although Mr Waddell offered reasons for not meeting the contracted weights we did not believe there were many mitigating factors. Of particular concern was Mr Waddell’s record which is a considerable aggravating factor. In addition, the two races he was replaced for were a Listed race and a Group 3 race. It was fortunate that the connections of both horses found adequate replacement riders.
