Following the running of the www.wehavetheshot.com 3YO Mr D.G Bradley, rider of the third placed horse, PLATINUM TOULOUSE, lodged a protest against the winner JESDA JABRA (S. Spratt) on the grounds of interference at the top of the straight.

The margin second to third was a nose. JESDA JABRA won by two lengths.

At the hearing Ms Latta, trainer, Mr N. McAlister, owner and Mr Bradley represented the interests of PLATINUM TOULOUSE and Ms Evans, trainer, and Ms Spratt attended for JESDA JABRA.

Mr Bradley used the head, side and rear films of the field leaving the chute and joining the course proper to assert that JESDA JABRA took the field across the junction but moved out on entering the straight thereby presenting an inside line to Mr Bradley.Mr Bradley angled his mount in and believed PLATINUM TOULOUSE had got up to JESDA JABRA’s hindquarters when Ms Spratt shifted in forcing him to check his horse and change ground for an outside run. He believed his horse lost considerable ground as a result of this interference and notwithstanding a big weight (57kg) finished in a manner he believed would have won the race.

Mr McAlister used the camera in the 800 metre tower to support Mr Bradley’s claim that he was sufficiently up inside JESDA JABRA to be entitled to the run.

Ms Spratt acknowledged some inward movement on her part and resultant inconvenience to PLATINUM TOULOUSE but did not believe that there was a gap for PLATINUM TOULOUSE or that Mr Bradley had asserted his right to that line at the point he opted to change ground.

Ms Evans was also of this view and believed the gap was marginal at best.

Mr George,with particular reference to the film from the 800 metre tower, considered there was significant doubt PLATINUM TOULOUSE had got up inside JESDA JABRA to be able to claim the inside running line.

After reviewing the films and the submissions put to it the Committee finds that PLATINUM TOULOUSE did suffer a check when seeking to secure a run inside JESDA JABRA at the 400 metre point and lost some ground as a consequence.
--On the issue of relegation the Committee believes there is real doubt PLATINUM TOULOUSE, at the point at which Mr Bradley took hold of his horse, had worked into the gap to the extent he could claim that it was his rightful running line. Given that doubt the Committee declines to exercise its discretion to relegate JESDA JABRA and directs that the protest be dismissed and the judge’s placings stand.
