As Ms Spratt admitted the breach the charge was found proved.
Penalty:
Ms Spratt was suspended from the close of racing on Saturday March 24th up to, and including racing on Thursday March 29th in effect four days.
Charge:
Following the running of Race 1, the Mills Reef Winery Premier, an Information was lodged by Mr C George alleging a breach of Rule 638(1) (d) in that passing the 250m S Spratt permitted her mount SATURN ROCK to shift out when not clear of MADONNA MIA which was checked.
Facts:
Mr George used the head-on and side videos to show Ms Spratt racing in a position directly behind the leaders. Her horse was full of running and she angled outwards looking for clear racing room but in doing so was not clear of MADONNA MIA which resulted in Mr Innes having to take hold of his mount.
Ms Spratt explained the horse in front of her was stopping, which is why she angled out but agreed she had not been the required distance clear of Mr Innes when she did so.
Submissions for Penalty:
Mr George produced Ms Spratt’s riding record which showed three previous careless riding charges incurred over the last 12 months. He said the degree of carelessness was mid-range however the resultant interference to the other horse he considered mid to low.
Ms Spratt had no submission to make in regards to penalty but advised she had riding engagements through until racing on Saturday March 24th. She also said she only rides in the South Island for the racing carnivals.
Reasons for Penalty:
In coming to a decision on penalty the committee took into account all of the submissions. Ms Spratt did not make a simple error of judgement but shifted out abruptly when seeking clear racing room. She was perhaps fortunate that the resultant interference was not more serious. We considered her actions to be in the mid-range of carelessness and adopted as a starting point a suspension of five riding days. Ms Spratt has a very good riding record which we gave her credit for and we also took into account her admission of the breach.
