FACTS

Following the running of Race 1, the Military Move Cup, a protest was lodged by rider Matthew Gillies alleging that IRISH CHARMER or its rider placed 3rd by the judge caused interference to WILBUR placed 4th by the judge. The interference occurred in the home straight.

The judge’s placings were:

--1 BAYLY ROAD
--7 IRISH CHARMER
--6 WILBUR
--3 THE BEAUT

The margin between the two horses involved in the protest was a neck.

SUBMISSIONS

Mr. M. Gillies used the head-on, rear-view and side-on films to highlight the incident which he believed cost him 3rd place.

The head-on view showed Ms Rathbone on the favourite IRISH CHARMER looking for a run in behind the leaders. She angled her mount outwards making contact with Mr. Gillie’s mount WILBUR which was pushed out further onto a horse ridden by Mr. Kenny Watson. Mr. Gillies ended up being squeezed between two horses, lost momentum and then recovered to finish off the race strongly.

Mr. Stephen Gillies said that it was very difficult for a horse to recover from a loss of momentum when it was carrying 65 kilos.

Ms Rathbone, the rider of IRISH CHARMER, declined to comment but Mr. Myers said that while contact had been made the majority of the interference suffered by WILBUR was caused by Mr. Watson’s mount not Ms Rathbone’s.

Mr. Goodwin was asked for the stewards’ assessment and he said that while the protest had merit Mr. Watson’s horse may have contributed to the interference.

DECISION & REASONS

Mr. Gillies was fully justified in lodging a protest and the committee carefully considered all the evidence and revisited the films in detail.
----
There was no doubt that WILBUR lost momentum at a vital stage of the race when ending up in tight quarters between two horses. It then went on to finish the race strongly getting to within a neck of IRISH CHARMER who ran third.
----
In coming to a decision on whether to uphold the protest the committee had to decide whether IRISH CHARMER (J.Rathbone) was the sole cause of the interference or if the mount of Mr. K. Watson had contributed.
----
We were of the opinion that Mr. Watson’s horse moved inwards slightly and contributed to some degree to the incident therefore the protest was dismissed and placings allowed to stand as called by the judge.
