Due to the charge being admitted together with the film evidence the charge of careless riding was deemed proved.

Mr Colgan’s Jockey’s Licence was suspended from the end of racing on 23 January through to 10 February 2021 inclusive (8 days) and fined $1,000.
Facts:
Following the running of Race 6 (Devan Plastics Levin Classic) Information A14119 was filed with the Judicial Committee. It alleged that Mr Colgan the Rider of MOANA permitted his mount to shift out near the 400m where there was insufficient room, making contact with BRANDO (D Johnson) which was unbalanced.
Mr Colgan said that he understood the Rule, charge and confirmed that he admitted the breach.
Mr Goodwin showed all available film replays and identified both horses and riders. He said that as the field straightened up MOANA shifted out and attempted a run inside BRANDO when there was insufficient room. He said that there was bad jostling for a short distance.
Mr Colgan said that he thought that there was room but that it (gap) shut pretty quickly. He said that it was a sticky situation and that it took a little while to ease out of the position inside BRANDO.
Submissions for Penalty:
Mr Oatham said that Mr Colgan had one prior breach in the last 12 months that being on 26 December 2020 when a 4-day suspension and a fine of $600 was imposed. The Stewards placed the carelessness in the mid-range category. Mr Oatham invited the Committee to consider that it was a Group I event.
Mr Colgan asked that any suspension commence after racing on 23 January 2021.
Reasons for Penalty:
The Committee placed the carelessness exhibited by Mr Colgan as no less than mid-range. Mr Colgan and his mount shifted out for a run inside BRANDO when there was insufficient room to do so. As a consequence of that shift BRANDO was jostled and also received two firm bumps.
The JCA starting point for such careless riding is a 5-Riding Day suspension and a fine of $500. We have taken into account that it was a Group I event with prize money of $225,000.
Acting pursuant to Rule 920(2) the Committee determined that an uplift in penalty to 9 Riding Days suspension and a fine of $1,000 was a condign penalty with a discount of one day given for Mr Colgan’s record.
