As Mr Bradley admitted the breach we found the charge proved.

Penalty:

Accordingly Mr Bradley is suspended from riding from the conclusion of racing today, Saturday March 14th, up to and including racing on Sunday March 22nd. The days included in this suspension are:

Facts:

Following the running of Race 8, The Paper Source Cuddle Stakes Group 3, an Information was lodged by Mr J Oatham alleging a breach of Rule 638(1) (d) in that rider D Bradley allowed his mount IRION to shift outwards near the 100 metres checking GWYNETHANNE when not sufficiently clear.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Bradley acknowledged he understood the nature of the rule and confirmed he admitted the breach.

Mr Goodwin highlighted the incident using the three available video angles. Mr Bradley was racing midfield with Mr Parkes on GWYNETHANNE wider out. Approaching the 200 metres GWYNETHANNE (J Parkes) shifted outwards independently when racing greenly. Mr Bradley proceeded to angle outwards on IRION placing GWYNETHANNE in restricted room. It was estimated by the Stewards that Mr Bradley was only a bare length clear when he moved out. Mr Parkes had advised the stewards that his horse was tiring but Mr Goodwin said he was nevertheless entitled to a clear run.

Mr Bradley said GWYNETHANNE rolled out under pressure and allowed a gap to open for him however he admitted that he wasn’t the required distance clear when he moved outwards. Mr Bradley estimated he was 1 ½ horse lengths clear rather than the required two lengths and it was simply a slight lapse of judgement.

Submissions for Penalty:

Mr Oatham said Mr Bradley had admitted the breach promptly and had a good record with only one charge of careless riding (November 2014) in the last 12 months. He said an aggravating factor was the Group 3 status of the race. The Stewards assessed the degree of carelessness as somewhere in the mid-range and submitted that a term of suspension in the vicinity of 5-6 days was appropriate.

Mr Bradley said he had admitted to riding carelessly but at no stage did he put any horse or rider in danger. He said the head-on and rear-view films clearly showed some interference to IRION however the side-on film showed it to be not very serious. Mr Parkes and Mr Colgan were having a bumping duel of their own well before the incident.

Reasons for Penalty:

In coming to a decision on penalty the committee took into account all of the submissions presented and adopted as a starting point a five day suspension. It was our opinion that the degree of carelessness was slightly below the mid-range. Mr Bradley angled out for a marginal gap when not quite the required distance clear and despite Mr Parkes having to take a hold of his mount Mr Bradley’s actions did not affect the chances of any other runner. Mitigating factors were Mr Bradley’s excellent riding record and his admission of the breach. In our opinion a five day suspension was an appropriate penalty. Mr Bradley advised he rode throughout the country and gave recent examples of riding in the North and the South Islands. Despite having offers to ride next Saturday in Canterbury Mr Bradley said he would prefer to start any suspension immediately. Mr Oatham questioned Mr Bradley on how firm his commitments to trainers were for next Saturday. Mr Bradley said nothing had been set in concrete, nominations did not close until Tuesday and he had not formally accepted any rides.
