Facts:
Following the running of Race 5 (Carters 1600) Information A14137 was filed with the Judicial Committee. It was alleged by the Informant that Ms Hemi had used her whip excessively prior to the 100m.
Ms Hemi said that she understood the Rule, the charge and confirmed that she admitted the breach.
Mr Goodwin showed the film replays and identified Ms Hemi and her mount JESSIEGEE. He said that Ms Hemi had struck her mount 8 times with her whip prior to the 100m (5 strikes is the maximum permitted).
Ms Hemi agreed with the number, but said that the first two were backhanders and were not forceful.
Submissions for Penalty:
Mr Goodwin said that Ms Hemi had one breach on 21 November 2020 when a $500 fine was imposed. He added that she is a sought after Rider who does have a high number of rides and as such her record is relatively good. He said an aggravating factor would be that she dead heated for first placing.
Ms Hemi confirmed her record was correct and had nothing further to add.
Reasons for Penalty:
We were satisfied that Ms Hemi had struck her mount 8 times with the drawn whip prior to the 100m.
We also observed on the film replays that the whip use was not continuous, with a number of breaks being afforded.
We accept Ms Hemi’s comment that the first two strikes were backhanders with little force being used.
The JCA Penalty Guide starting point for a second breach within 6 months is a fine of $500.
After giving careful consideration to all matters in relation to penalty we determined that a fine of $500 was a suitable sanction.
