Following the running of Race 3, the Sandbar Pub Maiden Hurdles, Mr. R. Doherty was charged with excessive use of the whip under rule 530 (2) (b). The information alleged that R. Doherty used his whip in an excessive manner on MAGIC MAN over the concluding stages.

Following the running of Race 3, the Sandbar Pub Maiden Hurdles, Mr. R. Doherty was charged with excessive use of the whip under rule 530 (2) (b). The information alleged that R. Doherty used his whip in an excessive manner on MAGIC MAN over the concluding stages.
--Mr. Doherty admitted the breach of the rule.
--After jumping the final fence when the horse was tired and well out of contention Mr. Doherty gave it five or six hard strikes of the whip. This was unnecessary as the horse was not responding and had no chance of improving its position in the race.
--Mr. Neal said the Stewards put the offence in the mid-range of excessive whip use.
--Mr. Doherty said that he had had about 15 rides over jumps in New Zealand and that in hindsight he was aware that he had made an error of judgment.
--From previous experience riding MAGIC MAN he thought that the horse would lift again close to the finish but on this occasion it had not.
--Penalty
--The committee took into account all of the submissions including Mr. Doherty’s excellent record and his full and frank admittance of the breach.
--There has been a lot of negative publicity about the use of whips in racing and drawing the stick on a tired horse for no gain in a race will not be tolerated either by the Stewards or the general public.
--Mr. Doherty is fined the sum of $200.00.
