Information 042 was filed by Stipendiary Steward Mr R Neal against Mr J Symes under rule 520 (4) (c) alleging that “Jason Symes failed to make the weight for Splenda (Race 6) and Electriclite (Race 9).
--Rule 520 (4)(c) states “Every rider commits a breach of these rules who.....wilfully or without reasonable cause permits himself to be engaged to ride a horse when he knows or ought to know that he will not be able to ride the horse at weight which it is handicapped to carry or such other weight at which he agrees to ride the horse”.
--Mr Symes indicated on the information he admitted this breach of the rules and he confirmed this at the hearing. He also agreed he understood the charge and the rule it was laid under.
--Stipendiary Steward Mr Neal said Mr Symes had recently returned to race riding this being his 4th day back riding after having a 12 month break. He said Mr Symes had advised him that earlier this morning he was 1 kilo over the carded weight of 56kgs for both horses. Fortunately, despite there being a shortage of riders, both trainers had been able to find replacement riders.

Penalty Submission
Mr Neal thought the matter should be dealt with by way of a modest fine.
Mr Symes said that he couldn’t afford to be suspended as he was re-starting his riding career. He admitted he had struggled a little with his weight previously but thought that today’s one kilogram over was just down to still getting race fit.
He has put in the Racing Calendar that he can ride at 56kgs which he does not foresee as being a problem in the future.
Decision
In coming to a decision on penalty the Committee considered all of the submissions. Mr Symes is a talented rider and a welcome addition back into the ranks of Central Districts jockeys so it is hoped that he can control his weight in the future. We are imposing a fine of $200 which is consistent with other penalties taking into account that two trainers were affected and required to find alternative riders.
