Information 041 was filed by Stipendiary Steward Mr R Neal against Mr V Singh under rule 871(1)(d) alleging that “Vydhir Singh the rider of LITTLE SINGA has allowed his mount to shift outwards in the final stages resulting in ADDICTED (K Myers) having to check her mount”.
--Rule 871(1)(d)) states “Every rider commits a breach of these rules who in the opinion of the Judicial Committee is guilty of riding that was ......careless”.
--Mr Singh was assisted at the hearing by his employer - licensed trainer Mr G Vile. Mr Singh said he understood the charge and the rule it was laid under. He indicated on the information he admitted this breach of the rules and he confirmed this at the hearing. The charge is therefore deemed to be proved.
Stipendiary Steward Mr Neal said Mr Singh was travelling one off the rail at the 150m mark when he commenced moving out some four horse-widths while continuing to ride his horse with vigour. He said that Mr Singh was leading at the time and had an opportunity to win the race. As he started moving out Ms Myers was only a half length behind him. He should have taken immediate corrective action to alleviate the pressure on Ms Myers. By not doing so she received a severe check and lost between two and three lengths. Mr Neal indicated, however, that had Ms Myers not been checked he believed she would not have finished closer than the 3rd placing she achieved.
Mr Singh had no comments to make but confirmed that he had been riding in New Zealand for approximately 12 months.
--Penalty Submission
--Mr Neal advised that this was Mr Singh’s first breach of any rules since he commenced riding in New Zealand. He had, however, not taken any remedial actions to correct his significant outward movement and as a result the safety of both himself and Ms Myers had been compromised.
--Mr Neal placed the level of offending in the mid to high range and left it with the committee to impose a suitable penalty.
--Mr Vile said that he did not disagree with anything Mr Neal had said.
Mr Singh is a left-handed rider who had become a little bit excited at the prospect of achieving his first winning ride in New Zealand on a horse trained by his boss.
He asked for leniency saying that since transferring to his employ 3 months ago he had made significant improvement both as a rider and as a young man. He confirmed that Mr Singh had no firm engagements in the next 7 days.
Decision
--In coming to a decision on penalty the committee took into account Mr Singhs admittance of the breach and his excellent riding record. The Stewards described the degree of carelessness as in the mid to high range. Considering how Mr Singh allowed his horse to move outward without taking any corrective action we concur with that assessment. Normally we would consider a five day suspension, however taking into account all of the submissions including the positive comments made about Mr Singh by his employer we are prepared to mitigate that down to four days. Mr Singh is suspended from the close of racing today Saturday 11 April 2009 until the close of racing on Thursday 23 April 2009.
