As Ms Hemi admitted the breach we found the charge proved.

Accordingly Ms Hemi’s license is suspended from the close of racing on Saturday March 17th up to and including racing on Thursday March 26th 2018.
Facts:
Following the running of Race 6 (Hiremaster Handicap 1200m), an Information was lodged by Mr N Goodwin alleging a breach of Rule 638(1)(d) in that jockey L Hemi allowed her mount to shift inwards when not clear of BRING TO THE BLOCK, ISLAND BAY and VATICAN NEWS with ISLAND BAY and VATICAN NEWS checked near the 100m.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Ms Hemi confirmed to the Committee that she understood the charge and that she admitted the breach.
Mr Goodwin said there was “a fair bit going on” prior to the incident and had Mr Balcombe outline the sequence of events using the films. The head-on view showed three horses across the track; VATICAN NEWS (M Hills) on the fence with ISLAND BAY (R Elliot) to his outside and Ms Hemi (MALO BIK) the widest of the three. In behind these runners was Mr McNelis (BRING TO THE BLOCK). Mr McNelis proceeded to go for a gap between Ms Hemi and Mr Elliott, a run the Stewards described as marginal but legitimate. Initially Mr Elliott rolled out slightly which caused some interference to Mr McNelis but it was only when Ms Hemi rolled inwards (when only ¾ length clear of Mr McNelis) that caused the two runners on the fence to be checked.
Ms Hemi admitted she should have straightened her mount earlier. She heard Mr Elliott calling out, and assumed he was calling to her because she was unaware of Mr McNelis coming through on her inside. She thought the gap he attempted was only a marginal one.
Submissions for Penalty:
Mr Goodwin produced Ms Hemi’s riding record which showed one suspension for careless riding in the last 12 months at Taranaki on December 12th (5 days). He described this as a very good record and said today’s breach fell in the mid-range. When asked to expand further on the mid-range classification Mr Goodwin said Ms Hemi had not moved in very much but the consequences of that movement were midrange, in that two horses were checked. The Stewards’ submission was for a term of suspension in line with the degree of carelessness.
Ms Hemi advised of a riding commitment next Saturday and requested a deferment of any suspension until after that date.
Reasons for Penalty:
The Committee had regard to all of the submissions and viewed the films many times. When looking at the mowing strips on the track it was clear that Ms Hemi did not move inwards a great amount, approximately one horse-width. Mr McNelis pushed into a very narrow gap to her inside, and only his horse’s head was established in the gap at the time Ms Hemi moved inwards. We accept her statement that she was unaware of him being there. As soon as she heard calling she pulled her mount outwards, albeit too late. We find that if Mr McNelis had not attempted the gap the incident would not have happened however we also accept that the gap was a legitimate one and had Ms Hemi not rolled in the incident would not have happened.
We placed her degree of carelessness as low end but the consequences as midrange. Both ISLAND BAY and VATICAN NEWS were badly buffeted and lost ground.
We adopted a starting point of 7 days and allowed a one day discount for Ms Hemi’s very good record and her admission of the breach. In our opinion an appropriate penalty is a suspension of six days.
