Charge:
Mr Neal lodged an information with the Judicial Committee alleging a breach of Rule 330 (3) (c) in that J Riddell failed to make the required weight for JAKBLAK in Race 9.
Facts:
Mr Wall who is Mr Riddell's agent arranged for Mr Riddell to ride JAKBLAK in Race 9 today at 56kgs. Early in the day Mr Riddell notified the stewards and the trainer that he couldn’t make the weight. They said that since he was riding in the last race he could have some time to try and get down to the correct weight. Mr Riddell remained 1.5kgs over the carded weight and the connections were given the option, by the stewards, to either allow Mr Riddell to take the ride overweight or scratch the horse from the race. There was no replacement rider available on course and the horse was subsequently scratched.
Mr Riddell acknowledged that he had difficulty with his weight and said this was an ongoing issue for him. One of the owners had approached him after learning that he was overweight and had made his displeasure known. Mr Riddell completely understood their anger and was extremely remorseful.

Mr Neal advised the committee of four previous charges against Mr Riddell in the last 12 months. Penalties for these were:
5/12/10 - $100
15/3/11 - $100
4/5/11 - $300
3/9/11 - $300
He said that some of the owners had flown down from Hamilton to watch their horse race and had been severely disadvantaged. He said that Mr Riddell was always honest and cooperative in all instances and submitted that a fine of not less than $300 be imposed.
Mr Riddell reiterated his remorse and said that he would be contacting the owners and offering to pay the return float fees for the horse from Palmerston North to Trentham.
Reasons for Penalty:
The committee considered all of the submissions. In mitigation Mr Riddell did advise everyone early of his inability to make the weight and it was perhaps unfortunate that there was no replacement rider available. We also took into consideration his offer to pay travelling costs for the horse which would be some monetary relief for the connections.
Aggravating features are Mr Riddell’s record and the fact that JAKBLAK had to be scratched from the race. Mr Riddell and his agent perhaps need to communicate more directly and on a daily basis about what weight Mr Riddell can accept rides at. The connections of the horse have been badly let down by Mr Riddell's inability to make the 56kgs today. Not only has it cost them money to travel down from Hamilton but it has cost them the enjoyment and anticipation of watching their horse race.
