Following the running of Race 9, The Oaks Stud Telegraph Handicap (Group 1) Ms K.Myers was charged with careless riding under rule 638 (1) (d). The information alleged that K. Myers permitted her mount STUPENDOUS to shift outwards near the 300 metres when not sufficiently clear of VELOZ (M. Hills) which was forced into the line of WALL STREET (B. Lammas) which clipped a heel and blundered.

Following the running of Race 9, The Oaks Stud Telegraph Handicap (Group 1) Ms K.Myers was charged with careless riding under rule 638 (1) (d). The information alleged that K. Myers permitted her mount STUPENDOUS to shift outwards near the 300 metres when not sufficiently clear of VELOZ (M. Hills) which was forced into the line of WALL STREET (B. Lammas) which clipped a heel and blundered.

Ms. Myers did not admit the breach of the rule.

Mr. Oatham asked Mr. Goodwin to outline the incident using the films. The head-on video showed Ms Myers (STUPENDOUS) racing in a position directly behind MUFASA with the weakening VELOZ on her outside. VELOZ shifted in momentarily and made contact with STUPENDOUS.  After this point Ms Myers angled her mount outwards looking for a clear run but in doing so was not clear of VELOZ.  The rear view film confirmed the outward movement by Ms Myers and showed her continue to ride forward with vigour as she did so.

Mr. Oatham called Mr. Lammas as a witness. He told the committee that he was attempting to go through a gap between two horses but when half way into that gap it closed on him with the result that he clipped heels, stumbled and was almost dislodged from WALL STREET.  The gap closed due to pressure from VELOZ on his inside and maybe slight pressure from VONUSTI on his outside.

Mr. Hills, rider of VELOZ, was the next witness called. He said he received buffeting from the inside (STUPENDOUS) which pushed him into the line of WALL STREET. He said that he did not move inwards and make contact with Ms Myers prior to her moving out onto him. As his horse was already tiring he did not believe his own chances had been affected.

Ms. Myers told the committee that she was tracking MUFUSA when VELOZ rolled in made contact with her and put STUPENDOUS off balance. She maintained that this initial movement by Mr. Hills turned her sideways and had the effect of causing STUPENDOUS to lean back on VELOZ. She said that WALL STREET was attempting a minimal gap anyway and that she was not responsible for the interference it received. She was put off balance by VELOZ and from then on she believed she was a victim of circumstances.

Mr. Oatham in summing up said that at no point was there a clear run for Ms Myers and that she continued to ride forward with no correction. He said that if it there had been no shift from Ms Myers the incident would not have happened.

DECISION

--

The committee thoroughly considered all of the evidence including the films in great detail.
 Mr. Hill’s evidence was less than compelling and we favoured Ms Myers assessment of the initial tightening. It was our opinion that Mr. Hills did initially allow VELOZ to move inwards which caused general bumping as all the horses involved were racing in tight quarters.

The blunder of WALL STREET however occurred after this when Ms Myers continued to ride forward on an outward path. She was not sufficiently clear when she moved into the line of the tiring VELOZ which then moved into the line of WALL STREET.
Accordingly we found the charge of careless riding proved.

PENALTY

--

Mr. Oatham said that Ms Myers has had two previous careless riding charges in the last 12 months.

Today’s charge resulted from an incident in one of New Zealand’s flagship races, a Group 1 race with a stake of 1 million dollars. Mr. Oatham said that Wall Street had its chances virtually extinguished however there were some mitigating factors as alluded to by Ms Myers.

His recommendation was for a 2 week suspension and a fine.

Ms Myers asked the committee to consider that there were contributing factors to the incident and advised that she had commitments at Trentham next Saturday.

--

In coming to a decision on penalty the committee considered all of the submissions including Ms Myers riding record which we considered to be very good.  We also had regard to the status and stake of the race as per Rule 920 (2) (a) & (b). This was the Telegraph Handicap, a Group One race worth 1 million dollars in which Ms Myers finished in third place.

--

WALL STREET had its chances severely hampered and was fortunate to stay on its feet. While Mr. Lammas may have been attempting a very marginal gap Ms Myers actions played a major part in the incident.

--

In setting the term of suspension we considered Ms Myers riding commitments this Saturday and the fact she rides throughout the country.

--

She is suspended from the conclusion of racing on Saturday January 30th until the conclusion of racing on Friday 12th February which is one day short of 2 weeks.

--

In addition we have imposed a monetary penalty of $1200.

--
