As Miss Cowan had admitted the breach it was deemed to be proved by the Judicial Committee.

Penalty:

Miss Cowan’s Apprentice Jockey’s Licence was suspended from the end of racing on Sunday 8th October up to and including racing on Sunday 15th October 2017 (Five days).

Facts:

Following the running of Race 5 (Mitavite 1200), Information No. A9210 was filed with the Judicial Committee. The Informant alleged that Miss Cowan (PINSRAAD) had allowed her mount to shift ground in the home straight when not clear of DRAMATIST (Miss A Collett).

Rule 638(1)(d) provides: -
A rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless

Miss Cowan said that she understood the Rule and confirmed she admitted the breach.

Stipendiary Steward, Mr Whiterod identified the two horses involved on all available film replays. He identified PINSRAAD shifting in which resulted in Miss Collett restraining her mount (DRAMATIST) for several strides.

Mr Whiterod said Stewards believed the movement and check to DRAMATIST certainly cost the horse a closer finish than the fifth finish achieved. He said that just prior to the interference; Stewards believed DRAMATIST was ahead of the eventual third place getter PETITE EN JEU. Mr Whiterod said if it had not been for the incident, Stewards believed DRAMATIST would have finished fourth and possibly third.
He reaffirmed that Miss Cowan has ridden her horse with vigour while her mount shifts in when not the required distance clear and carried on to win the race.

Miss Cowan, in response, said she believed there was outward pressure from an inside runner HUNDYAMONTH, which was moving out. This had contributed to the interference, making it look worse, she said.

Miss Myers said there was no denying that Miss Cowan had shifted in probably two horse widths, but contributing to the interference was HUNDYAMONTH ducking out under pressure.

To a question from the Committee Mr Whiterod said in the Stewards opinion any outward movement of HUNDYAMONTH was very slight and not a significant contributing factor to the interference.

Submissions for Penalty:

Mr Balcombe viewed the interference to be in the low-end range with an aggravating factor being that the interference cost the affected runner one, or possibly two, better placings.

To a question from the Committee, Mr Balcombe assessed Miss Cowan as a national rider saying her riding record included riding in the Waikato, South Island as well as the lower North Island.

He said Miss Cowan had a good riding record for a busy rider under the careless riding rules, her most recent breach being April 29th when she was suspended for three riding days.

Following a question from the Committee in regard to Miss Cowan’s upcoming riding engagements, a discussion took place before Miss Cowan chose not to seek a deferment, if her penalty was a suspension.

Reasons for Penalty:

In fixing quantum of penalty, the Committee had regard to the JCA starting point of 5-riding days suspension for careless riding. The Committee placed the level of carelessness in the mid-range category as Miss Cowan’s actions had probably cost DRAMATIST a better final placing. For this the committee uplifted the starting point to six days.

The mitigating matters were Miss Cowan’s good record and that she admitted the breach for which she is afforded a discount of one day.
