Information No. A6758 read that Allan Sharrock failed to scratch TIHI KEEPA by the required time.
Rule 534(1) reads:
At any time from the withdrawal deadline to the scratching deadline (as specified for the relevant race meeting in accordance with Rule 510(d)(v) or as amended by NZTR from time to time) on the relevant race day, a person intending to scratch a horse from a race (after it has been accepted or is deemed to have been accepted) shall give notice to that effect to NZTR and where such notice to scratch a horse refers to a race meeting but does not specify a particular race at that meeting such notice shall be deemed to apply to all races for which the horse has been accepted or deemed to have been accepted at that race meeting.
Mr Sharrock said that he understood the rule and confirmed that he admitted the breach.
Mr Goodwin outlined the situation and said that Mr Sharrock scratched the horse at 7.41am and as there was balloted horses in the event that a horse missed a start. After consultation with the CEO of NZTR, TIHI KEEPA was reinstated at 7.55am with the trainer of the first balloted horse GOLDEN PENNY being contacted and told that he could now start the horse in the event. Unfortunately the trainer of GOLDEN PENNY, Mr Gray, advised that he had galloped the horse and that it could not start. The connections of the next balloted horse PADDY JO accepted the invitation to start.
Mr Sharrock said that the late scratching of TIHI KEEPA was an oversight on his part as he was busy working horses at the time.
Submissions for Penalty:
Mr Goodwin informed the committee of penalties that had been imposed over the last two racing seasons and said that they ranged from $150 to $400.
Mr Sharrock did not have anything to say regarding penalty.

The committee considered all matters relevant to penalty and determined that a fine of $200 was appropriate.
