Facts:

Following the running of Race 6 (Moore Stephens Markhams 1650m) Stipendiary Steward Mr N Goodwin filed Information A7689 instigating a protest against the connections of HIDDEN AGENDA who finished 2nd, alleging interference with BIGREDMOON which finished 4th.

Rule 642(1) states: If a placed horse or its Rider causes interference within the meaning of this Rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with.

The rule was read and all parties confirmed they understood Rule 642(1).

The provisional placings were:

1st (2) SPIKER
2nd (7) HIDDEN AGENDA
3rd (1) O’CEIRINS WHISPER
4th (9) BIGREDMOON
5th (3) THATZ LOUIE
6th (6) CUZZIE CHARLIE

The margin between second and third was a neck with a nose back to fourth.

Submissions for Decision:

Mr Balcombe identified both horses on the films. Using the head-on and side-on films, Mr Goodwin pointed out that approaching the 200m, HIDDEN AGENDA (A Chan) started to roll around, then shifted inwards and when being corrected had shifted outwards into the line of BIGREDMOON (D Turner), requiring Mr Turner to take some evasive action at that point. Mr Turner then had to finish the race off to the inside of HIDDEN AGENDA. Mr Goodwin stated that after consideration of the margins, the stipendiary stewards believed the interference was worthy of an objection. He also noted that BIGREDMOON appeared to be finishing the race off at the finish.

The rider of BIGREDMOON, Mr Turner, used the films to indicate that he had to turn his horse’s head quite abruptly, and then was held up for approximately two strides before he could get an inside run. He believed his horse was finishing the race off well and that without the interference he would have run second. He also did not believe his horse’s head was hanging out, prior to his horse changing ground.

Ms Clements had no submissions to make.

The rider of HIDDEN AGENDA, Mr Chan, agreed that his horse had shifted inwards but that he had straightened his mount immediately after. Using the side-on film he pointed out that Mr Turner had stopped riding over the concluding stages, and that over the final 10 to 20 metres BIGREDMOON had laid in a little, resulting in BIGREDMOON losing ground. He accepted that his horse shifted inwards, but believed that he was one stride clear of Mr Turner and re-iterated that prior to the winning post Mr Turner had stopped riding.

Mr Sharrock accepted that his horse had moved out a fraction and believed that Mr Turner was going to take an outside run but had changed his mind and switched to the inside. He did not think Mr Turner stopped riding his horse as a result. He also agreed with Mr Chan that over the final 25 metres Mr Turner had not ridden his horse out. He also noted that it was very testing ground and that it was difficult to keep a horse straight. Looking at the way both horses had run to the line, Mr Sharrock did not believe it had affected the outcome as the horse that had finished third (O’CEIRINS WHISPER) had also finished over the top of BIGREDMOON.

Reasons for Decision:

After hearing all the evidence and reviewing the relevant films, the committee considered the submissions relating to the alleged interference over the final stages. It was clear, based on the films, and in particular the head-on and side-on films, that interference did occur at approximately the 200m mark. While it could be difficult for a horse to keep a straight line in testing conditions, HIDDEN AGENDA did move into the line of BIGREDMOON; however this did not seem to have a sustained impact upon Mr Turner’s ability to ride his horse out to the line. We observed that BIGREDMOON had a trouble-free run to the line over the concluding stages and did not appear to be making any significant ground on HIDDEN AGENDA.

Consequently, it follows that had the interference not occurred we could not be satisfied that BIGREDMOON would have beaten HIDDEN AGENDA.
