The committee was satisfied that Mr Chan had ridden carelessly and as the charge was admitted it was deemed to be proved.

Penalty:

Mr Chan was suspended from riding in races from the end of racing on July 1st 2017 up to and including July 15th 2017 (5 days).

Facts:

Following the running of Race 1, (Orion Synergy Maiden 1200), Information No A8772 was filed with the Judicial Committee. It alleged that Mr Chan allowed his mount ROYAL EMPRESS to shift in over the final stages and check POPCORN when not sufficiently clear.

Rule 638(1)(d) provides:
A rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless.

Both Mr Chan and Mr Sharrock acknowledged that they understood the rule and Mr Chan confirmed that he admitted the breach.

Mr Whiterod showed both the side and head on film from about the 100m mark to the finish and identified Mr Chan’s mount ROYRAL EMPRESS (the race winner) and the other horses concerned; second placed MAGICELLA (Mr D Turner) and POPCORN (Mr S McKay) who finished third.
Mr Goodwin said near the 100m mark Mr Chan was using the whip and his mount was beginning to run in. At about the 50m mark Mr Chan shifted into the line of POPCORN, tightening that runner and forcing its rider to check his horse. Mr Goodwin said Chan made only a “partial’ attempt to straighten his horse and his action was too little and too late. Mr Chan went on to win the race comfortably by a length and three-quarters from MAGICELLA with POPCORN a long head back third.

Mr Chan admitted he had made an error of judgement and he should have reacted sooner than he did to prevent forcing Mr McKay to check his mount.

Mr Sharrock said he agreed to Mr Goodwin’s assessment of the incident, adding Mr Chan did take action to avoid causing interference, but it was not sufficient.

Submissions for Penalty:

Mr Goodwin advised the committee that while Mr Chan had breached the careless riding rule on five occasions inside 12 months one of those had been related to a different matter under the rules – slowing the pace of the race in the middle stages when in front. He said Mr Chan was a successful and sought-after rider getting a lot of rides and pointed out that it was just on six months since his previous breach at Awapuni in last December when handed a six race days suspension for a high end offence.

Mr Goodwin placed the carelessness in the low end and submitted a penalty of a period of suspension in line with that was warranted.

Mr Goodwin added, in his opinion, there was a very good chance that POPCORN may have finished second, but for the interference and that was an aggravating factor in the incident. He added while the interference may have been minimal, the result was significant and that should be taken into account.

Mr Goodwin submitted that an appropriate penalty in this case was a suspension.

Mr Sharrock said, on average, Mr Chan rode at three meetings most weeks and regularly got up to as many as six rides per day. He added that Mr Chan’s current career goal was winning the Central Districts apprentice title – currently he was 2nd and two wins off the pace - and, with that in mind, he was planning on riding at as many North Island meetings as possible.

Mr Chan indicated he held engagements at the Hawke’s Bay meeting on July 1st, 2017 and was not seeking a deferment of any suspension that may be imposed beyond that date. He also wanted the committee to know that he had been booked to ride Art Deco in the Listed Opunake Cup at New Plymouth on July 22nd and was very keen to fulfil that engagement.

Discussions took place and it was agreed that Mr Chan was a North Island rider.

Reasons for Penalty:

The Committee found that Mr Chan allowed his mount to shift near the 50m mark in the run down the final straight and ultimately forced Mr McKay to check his mount, POPCORN, when that runner was finishing strongly. While Mr Chan did make a token effort to correct his mount’s running line his efforts fell short of what was required to prevent interference.

In considering a penalty the Committee was mindful of the JCA starting point of 5-day suspension for careless riding and imposed a one day uplift for potentially costing a runner a better placing and a discount of one day for what the committee determined a low-end level of interference and his admittance of the breach.
