Following the running of Race 10, DML Builders LTD 2175 Stipendiary Steward Mr N Goodwin lodged an information instigating a protest alleging interference by the 3rd horse HYPNOTIZE or it's rider J Parkes,  interfered with the chances of NOT TELLING, placed 4th by the Judge in the home  straight



Following the running of Race 10, DML Builders LTD 2175 Stipendiary Steward Mr N Goodwin lodged an information instigating a protest, alleging interference by the 3rd horse HYPNOTIZE, or it's rider J Parkes,  interfered with the chances of NOT TELLING, placed 4th by the Judge, in the home  straight

Margin:  neck.

Mr Goodwin alleged in the  run to the line Mr Parkes allowed his mount to move in over the concluding stages, 75metres from the winning post, to crowd and jostle NOT TELLING over several strides preventing Ms Myres  from riding her mount out to the finish. Mr Goodwin demonstrated his interpretation of the incident with the use of the side and head-on films available.

Mr Fields for Mr Parkes felt his horse was finishing faster than NOT TELLING and did a little crowding short of the winning post but whether a neck margin was enough was hard to say.

Mr R Connors claimed  Ms Myres did not stop riding her mount to the line.

--

Mr G Vile stated the films show NOT TELLING was interfered with and Ms Myres had to stop riding her horse.   The chances of NOT TELLING finishing in a higher place were affected.

--

Ms K Myres stated it was very clear 10 strides short of the winning post where NOT TELLING received a knock by HYPNOTIZE and was put off balance for seven or eight strides. Not being able to ride her horse out at all, this has easily cost her ? of a length when she felt NOT TELLING was at least heading for second place. 

--

Mr Goodwin in summarizing said that clearly interference has taken place by HYPNOTIZE and the chances of NOT TELLING finishing in a higher placing have been affected.

--

The committee are satisfied that interference did occur and the chances of NOT TELLING finishing in a higher place were affected by the inwards movement and bumping by HYPNOTIZE, and the inability of Ms Myres to ride her mount out over the concluding stages of the race.

--

Applying their discretion the committee have given careful consideration to the degree of interference over the final stages of the race and the official margin of a neck .

--

Accordingly, the committee upheld the protest and the amended placings are-

--

1st#7,  2nd#11, 3rd#17, 4th#1, 5th#12, 6th#4.
