Facts:
Following the running of Race 5 (TOM ANDREWS CONTRACTING/GRANGEWILLIAM STUD 1650m), Information A9212 was filed with the Judicial Committee. It requested a ruling in relation to Rule 632(1) and stated: "That EEPA NEEMA was denied a fair start".
Rule 632(1) states: "If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away of its own accord), the Judicial Committee may declare such horse to be a non-starter."
Submissions for Decision:
Using the rear film, Mr Goodwin identified HUNDYAMONTH in barrier seven, with EEPA NEEMA to its inside in barrier six. HUNDYAMONTH was observed to rear at the start, on its own accord. EEPA NEEMA was then observed to lean inwards to get away from that horse. Mr Goodwin submitted that even though this was the only film available due to weather conditions, it was quite clear that Miss Collett's shoulder was then located behind the nearby attendant as a result of her horse leaning inwards. He believed that EEPA NEEMA had accordingly been hampered and was slow away.
Miss Collett advised that her horse had shied to the side of her barrier, away from the rearing HUNDYAMONTH. She believed she had been denied a fair start as when her mount eventually made it out of the gates, she was 100 metres behind the rest of the field.
Starter Mr Clement believed EEPA NEEMA had been denied a fair start, and that it being slow away was not a result of any deliberate action taken by the attendant.
Reasons for Decision:
Although there was only one film angle available, it was clear that HUNDYAMONTH had drawn barrier seven and had reared on its own accord just prior to the gates opening. This resulted in EEPA NEEMA, in adjacent barrier six, shying towards barrier five. It was clear from the film that when the field was dispatched, Miss Collett's shoulder was positioned behind the Starting Attendant so that she was unable to jump with the remainder of the field. This resulted in her being disadvantaged by some 100 metres. This impediment was not due to Miss Collett's own actions, nor was her horse the author of its own demise on this occasion. The committee determined that EEPA NEEMA had been denied a fair start and decided to exercise the discretion that Rule 632(1) permitted.
