The Information alleges that Mr Eager presented the horse EAGER ROCKET in an unfit condition to race.

DECISION AND REASON

--

The Information alleges that Mr Eager presented the horse EAGER ROCKET in an unfit condition to race. The horse was scratched by the club.

Mr Eager did not admit the breach and was present at the hearing. The rule was read (twice) and Mr Eager acknowledged he understood it.

Mr Hawea called Mr WJ Stewart, BVSc, (The official veterinary surgeon on duty). He stated that when he examined the horse EAGER ROCKET it had an open wound on its right shoulder, similar he said to a boil.

In answer to a question from Mr Eager he said it was not a rub mark that the horse could have got on the float on the way to the races. There were no further questions of Mr Stewart.

On Mr Stewart's evidence the Committee found the breach proven, Mr Eager for his part said he would not dispute Mr Stewart's view, as he was not a Vet.

Mr Hawea said it was a first offence by Mr Eager and perhaps the Committee would look at a monetary penalty.

When arriving at a penalty the Committee took into account it was Mr Eager's first offence, however, they were of the view a penalty must be imposed, because as a licence holder Mr Eager was responsible to see that his horse was presented at a race meeting in a fit and proper manner and be able to acquit itself to the best of its ability, and insure that owners and punters alike get a fair run for their money. A fine of $250 was imposed.
