As Mr Murray admitted the breach we found the charge proved.

Penalty:

Taking into account upcoming riding commitments Mr Murray is suspended from the close of racing on Saturday July 12th up to and including racing on Thursday July 31st. Central District, Waikato and Bay of Plenty race days only were included.

Facts:

Following the running of Race 4, Marley 1200, an Information was lodged by Mr N Goodwin alleging a breach of Rule 638(1) (d) in that apprentice rider B Murray allowed his mount ARCHANGEL to shift in near the 1000 metres dictating TATANIA inwards onto SIR HIKO which was severely checked. Also affected were CHECKOUT CHICK, YOUNGSYD, HIGH COMMISSIONER and SPEED QUEEN.

Mr Murray was assisted by Mr A Sharrock due to his employer, Mr Breslin, being in Australia. Mr Murray acknowledged that he understood the nature of the charge and confirmed his admission of the breach.

Mr Goodwin showed the head-on and side-on films of the incident playing both angles at normal race speed and again at slow speed. Mr Murray started from barrier number twelve in a fifteen horse field and soon after the start he commenced an inward movement with the intention of gaining a position closer to the running rail. Mr Stam (TATANIA), who was to his immediate inside, was dictated inwards onto SIR HIKO who was closest to the running rail. Mr Smith riding SIR HIKO was severely checked going sharply backwards through the field interfering with CHECKOUT CHICK who in turn caused further interference to YOUNGSYD (D Turner), HIGH COMISSIONER (J Riddell) and SPEED QUEEN (R Myers).

Mr Murray said he was not aware that there was another horse to the inside of Mr Stam and if he had noticed SIR HIKO (Mr Smith) on the rail he would have straightened his mount up. Mr Murray said everything happened really quickly and he wasn’t aware of the damage he had caused until he was shown the films after the race.

Submissions for Penalty:

Mr Goodwin said this was Mr Murray’s first charge in approximately 90 race day rides however an aggravating factor was the severity of the interference. He said Mr Smith was lucky to stay up and several other runners had been taken out of the race while Mr Murray had ended up winning the race. The Stewards’ submission was for a suspension in the vicinity of six to eight days.

Mr Sharrock said the films were self-explanatory however asked the committee to take into account that Mr Murray was an apprentice rider and he had readily admitted the breach. Mr Murray advised that while he is based in the Central Districts he has ridden previously at Te Aroha, Te Rapa and Waipa. Mr Goodwin and Mr Sharrock both said he did not ride in the Auckland and Northern areas.

Reasons for Penalty:

In coming to a decision on penalty the committee took into account all of the submissions and adopted as a starting point a period of five days suspension. Mitigating factors were Mr Murray’s excellent record and his admission of the breach which would normally afford him a discount of one day off the penalty.

The incident today arose when Mr Murray made a basic error of crossing from a wide draw when not sufficiently clear of the runner immediately to his inside. The head-on film clearly showed Mr Murray looking to his inside as he moved inwards indicating his awareness of Mr Stam but unfortunately he did not see Mr Smith closer to the rail. We placed the degree of carelessness in the mid to high range.

The consequences of Mr Murray’s carelessness however were dramatic. Mr Smith was severely checked with SIR HIKO being forced sharply back in the field losing several lengths and causing interference to four further runners. Rules are in place to protect the safety of horse and rider and to ensure that all runners are given fair and equal opportunity to gain the best possible placing. SIR HIKO was in a handy position when badly checked, and was fortunate not to fall. He crossed the line in last place. While it is not possible to conclude where the other runners might have finished had the incident not occurred the resultant interference was at the very high end and a significant aggravating factor.

Balancing all of the factors it was our opinion that an eight day suspension was an appropriate penalty.
