The Information alleges that F Cossey drove carelessly when striking the sulky wheel of SOUTHERN SCRUFF with approximately 1200metres to run,
The Information alleges that F Cossey drove carelessly when striking the sulky wheel of SOUTHERN SCRUFF with approximately 1200metres to run, resulting in interference to LORD PATROL resulting in this gelding being forced to race four wide.
--Mr Cossey was present at the hearing and did not admit the breach.
--The rule was read and Mr Cossey acknowledged he understood same.
--Films of the alleged incident were shown and interpreted by the Stipendiary Stewards. When asked by the Chairman did his horse LARY ROAD strike the wheel of SOUTHERN SCRUFF Mr Cossey acknowledged it did.
--After taking into account the films shown and evidence from the Stipendiary Stewards, the breach was found to be proven.
--Submissions as to penalty were then heard. It was the view of the Stipendiary Stewards and the Chairman that a suspension was inappropriate as Mr Cossey does not drive often and 3 to 4 days suspension would end up weeks rather than days.
--A monetary penalty was more appropriate and after due diligence a fine of $350 was imposed, taking into account Mr Cossey’s good record.
