After the running of Race 3 the Stipendiary Stewards lodged a protest into 3rd placing being awarded to FLAXTON FUN, alleging that the horse (FLAXTON FUN) had galloped in excess of 50 metres in the run home and therefore been in breach of Rule 870 (3) and the Breaking Horse Regulations.

Mr Dickson, the driver of the horse, represented the connections; the trainer Mr Tarrant had indicated to the Registrar he did not wish to attend.

The rule was read and those present acknowledged they understood same.

Films of the final 100 metres of the race were shown and clearly showed FLAXTON FUN break from its gait prior to the 50 metre mark and gallop from that point until past the winning post.

Mr Dickson did not wish to contest the Steward’s evidence nor the films shown.
----
The Chairman after viewing the films shown to him, was in no doubt that FLAXTON FUN was in breach of Rule 870 (3.) and exercised his discretionary power and disqualified FLAXTON FUN.
