--Rule 520 (4)(c) states “Every rider commits a breach of these rules who.....wilfully or without reasonable cause permits himself to be engaged to ride a horse when he knows or ought to know that he will not be able to ride the horse at weight which it is handicapped to carry or such other weight at which he agrees to ride the horse”.
--Mr Symes indicated on the information he admitted this breach of the rules and he confirmed this at the hearing. He also agreed he understood the charge and the rule it was laid under.
--Stipendiary Steward Mr Goodwin said Mr Symes had contacted him at approximately 9.45am to advise that he would be unable to make the weight for ADDASTAR in race 9 – the horse’s weight was carded as 57 kg. Mr Symes said he weighed himself at home in the morning and then went to the Wanganui course to weigh himself and saw he was 1 kg heavier on the course scales. He returned home and had a sweat bath and weighed himself again but was still 1 kg heavier than the course scales. He then said he rang Mr Goodwin to advise him of his situation.
--Penalty Submission
--Mr Goodwin advised that Mr Symes has been charged twice in the previous 6 weeks for the same offence and on both occasions had been fined $200. He said that if fined for today’s offence it should not be lower than $200. Mr Symes said he would prefer a suspension as he could not afford to pay any fine that might be imposed.
--Decision
--In coming to a decision on penalty the Committee considered all the submissions put before us. We recognise that you advised Mr Goodwin as soon as you became aware you would not be able to make the carded weight for ADDASTAR but also note that this is the third time you have been charged under this rule in the last six weeks. We are therefore imposing a fine of $300.
