As Mr Lammas admitted the breach the charge was found to be proved.

Penalty:

Taking into account all of the submissions we fined Mr Lammas the sum of $300.

Charge:

Mr Goodwin lodged an information with the Judicial Committee alleging a breach of Rule 330 (3) (c) in that B Lammas failed to make the contracted weight on ATOZED.

Facts:

Mr Lammas accepted the ride on ATOZED in Race 5 at a weight of 54kgs however after presenting to the races 1 kg over that weight he was replaced on the horse by Mr D Walker. Mr Goodwin explained that while riders are allowed to ride half a kilo over they will be replaced if any heavier than that.

Mr Lammas said that despite spending 4 – 5 hours in the spa this morning he could not lose that last half kilo. He said sometimes the weight comes off easily however today it did not. Following questions from the committee Mr Lammas said he had not done anything differently and his last “meal” had been half a lemon the night before the races.

Mr Goodwin produced Mr Lammas’ record under this rule which showed he had been dealt with under the minor infringement system on the following dates:

Mr Goodwin said this record was reasonably good and submitted a fine was an appropriate penalty.

Mr Lammas had nothing further to add.

Reasons for Penalty:

The committee considered the submissions and took into account Mr Lammas’ record and his admission of the breach. Although he had two charges in March there was a three month gap back to his previous charge. Mr Lammas is usually very conscientious in his attempt to make the correct weight. He can ride quite comfortably at 54 kgs but for some reason he had difficulty making that weight today despite spending a long time in the spa and eating next to nothing. In our opinion Mr Lammas made every effort to meet his contracted weight therefore we place this breach in the lower range.
