Facts:
Following the running of Race 3 (CORO ANGEL SYNDICATE OPN 1200), Information No.A10072 was filed with the Judicial Committee. It was alleged by the Informant that Mr Pinn directed his mount ART DECO outwards near the 450m when not sufficiently clear making solid contact with SHADOWS CAST which was unbalanced and forced outwards hampering PETITE EN JEU.
Rule 638(1)(d) provides:
A rider shall not ride a horse in a manner which the Judicial Committee considers to be: careless
Mr Pinn and Mr Sharrock said that they understood the Rule, Charge and confirmed that the breach was admitted.
Mr Oatham showed the film replays and identified the horses and riders involved. He said that near the 450m ART DECO was trailing the leader on the rail and that Mr Pinn then shifted his horse outwards abruptly making firm contact with SHADOWS CAST who as a result was forced out wider. Mr Oatham said that due to SHADOWS CAST being forced wider on the track PETITE EN JEU was also affected. He concluded by saying that ART DECO was only half a length clear when it shifted into the line of SHADOWS CAST.
Mr Sharrock said that Mr Pinn was on the favourite and that the leader was drifting back and that he (Mr Pinn) and his mount lost momentum. He added that Mr Pinn did cause some interference hence the reason the breach was admitted.
Mr Pinn did not make any comment as he said he was comfortable with Mr Sharrock’s submission.
Submissions for Penalty:
Mr Goodwin said that Mr Pinn had one breach of the Rule on record, that being on 9 August 2018 when a 5-riding day suspension was imposed. He said that Mr Pinn is a promising young rider who is in keen demand. Mr Goodwin said that on this occasion Mr Pinn shifted his mount outwards abruptly. He said that the Stewards placed the carelessness just below mid-range and recommended that a term of suspension be imposed.
Mr Sharrock confirmed that Mr Pinn’s record was as stated and asked that any suspension imposed commence immediately.
Reasons for Penalty:
The film evidence was very clear in showing that near the 450m Mr Pinn angled his mount away from the running rail somewhat abruptly making very firm contact with SHADOWS CAST. As a consequence of SHADOWS CAST being interfered with PETITE EN JEU was hampered. The Committee determined that the carelessness sat within the mid-range category and adopted the JCA starting point of 8 riding-days suspension. Due to the admittance of the breach and Mr Pinn’s record a discount of one day was given.
