Facts:
Following the running of Race 4 (Ken Duncan Racing Open Hurdle 3000m), Information A7661 was lodged by Mr Goodwin alleging a breach of Rule 636(1)(d). It stated that “Mr Perrett failed to ride THATZ DAVID out to the finish when in contention to finish in 5th place, and failed to do so”.
The Rule reads:
636 (1) A person:
(d) being the Rider of a horse in a Race, must ride his horse out to the end of the Race if there is a reasonable chance of it running into a position for which there is prize money to be awarded or a dividend to be declared;
Mr Perrett confirmed that he understood the rule and that he admitted the breach.
Mr Goodwin used both the head-on and side-on films to identify the incident. In the home straight THATZ DAVID jumped the final hurdle clearly in fifth position. Over the final few strides Mr Perrett was observed to put his whip away and allowed his horse to coast to the line. Mr Perrett finished in 6th place with a ½ head margin between 5th and 6th.
Mr Perrett described the incident as a simple misjudgement as he thought he was going to hold fifth position. He did not think THATZ DAVID was going to improve, and that was why he had put his whip away.
Submissions for Penalty:
Mr Goodwin said Mr Perrett had a clear record in relation to the previous 12 months. Mr Perrett had also readily admitted the breach when approached by the stipendiary stewards and the stewards submitted a fine not in excess of $350 as appropriate on this occasion.
Mr Perrett submitted his preference for a fine rather than a period of suspension. His justification for this was that it was fairly early in the jumping season and a fine would be more suitable given the limited riding opportunities that was available to jumps riders.

The JCA Penalty Guidelines identify a sliding scale for starting points of breaches of Rule 636(1)(d). The specified starting point for failing to ride out and missing 5th placing is $300.
Taking into account the recommended starting point of $300 the Committee has given Mr Perrett credit for his record and his admission of the breach. This is balanced against the minor stake monies that the connections have missed out on as a result of his failing to ride out.
