FACTS:
The Stewards charged Ms Leighton with a breach of r 638(3)(b)(ii) in that she used her whip excessively prior to the final 100 metres.
Mr Oatham demonstrated on the video that the Respondent struck her mount eight times before the final 100 metres of the race.
Ms Leighton agreed with this count and said she had simply made a misjudgement. It was her first race back riding where she thought she was in with a chance of winning.
Mr Harris commented that the strikes were not aggressive He said he was working with the Respondent on her whip use and that she was a good listener.
DECISION:
Ms Leighton admitted the charge and it is found proved.
PENALTY SUBMISSIONS:
Mr Oatham said the starting point in the JCA Penalty Guide is a fine of $300. He said Ms Leighton has had 93 rides and has ridden 14 winners. He said although this was black type race, consideration should be given to Ms Leighton’s record.
Mr Harris referred the Committee to Ms Leighton’s very good record.
PENALTY REASONS:
Ms Leighton has no previous breach of this Rule in her riding career which has been interrupted by injury. She is an Apprentice Jockey and has admitted the breach. The starting point in the JCA Penalty Guide is a $300 fine and balancing record against the fact that it is a Black Type race, this is the appropriate penalty.
PENALTY:
Ms Leighton is fined the sum of $300.
