DECISION AND REASON:

--

The information alleges that DANAMATOR or its rider, placed first by the Judge, interfered with the chances of SHARP STEAL, placed second by the Judge.

--

The alleged interference occurred in the home straight.

--

--

The rule was read and all those present acknowledged they understood it.

--

Present at the inquiry were Mr PA Taylor, rider of SHARP STEAL. Mr N Wood, trainer of SHARP STEAL. Mr R Hannan, rider of DANAMATOR and that horse's trainer, Mr M Breslin.

Mr Taylor demonstrated and interpreted head-on, side-on and rear view films of the alleged incident.

--

--

Mr Breslin made the observation that Mr Taylor never stopped riding with the stick.

--

--

Mr Wood for his part felt Mr Taylor had demonstrated the films well but wanted to add his horse was young and inexperienced and any bump would unbalance it.

--

Mr Hannan wanted it noted that his horse was never in front of Mr Taylor's mount as Mr Taylor had stated.

--

The Chairman asked Mr McCutcheon to confirm as near as possible to where the alleged incident occurred, he said approximately 250 to 300 metres from the winning post.

All parties confirmed that they had a fair hearing and had nothing further to add.

--

The Committee took into account all of the evidence, both verbal and films shown to them. Whilst there was a slight bump on SHARP STEAL that bump in their view was too far from the winning post to effect placings.

--

They therefore dismissed the protest, and ordered that the Judge's placings stand.

--
