Accordingly we found the charge of careless riding proved.

Penalty:

Accordingly Ms Wynne is suspended from riding from the close of racing on Sunday June 5th up to and including racing on Thursday June 23rd. This is a seven day suspension encompassing Southern and Central Districts race meetings.
After the penalty was delivered Ms Wynne advised that she was seeking help in an attempt to correct some aspects of her riding and the Stewards confirmed that they would be supporting her with this.

Facts:

Following the running of Race 4, John Turkington Forestry Castletown Stakes, an information was lodged by Mr N Goodwin alleging a breach of Rule 638(1) (d). The information alleged that Apprentice S Wynne permitted her mount TECHNICIAN to shift ground inwards near the 200m resulting in HONEY RIDER being dictated inwards in to the line of LORD ASCOT which was checked. Ms Wynne had Mr Kevin Myers assist her in the hearing.

Submissions for Decision:

Mr Goodwin called Mr Tanaka (the rider of HONEY RIDER) as a witness. He told the committee that near the 250m mark he was racing in behind Ms Wynne when he angled inwards to take a narrow gap between her horse and Mrs Allpress on the fence. As he did so Ms Wynne shifted inwards and tightened him up.

In response to a question from Mr Goodwin Mr Tanaka said he believed there was a gap available for him to move into. He said he was aware that Mrs Allpress was getting squeezed and he tried to relieve the pressure (as evidenced by him pulling on the outside rein) but was unable to do so because of Ms Wynne on his outside.

Mr Myers asked Mr Tanaka if his horse had raced kindly throughout the race. Mr Tanaka replied that it did over race early on but from the 800m it was relaxed. In response to another question from Mr Myers, Mr Tanaka said he did not stop riding his mount as he went through the gap. Mr Myers suggested to Mr Tanaka that he “used” Ms Wynne to cut off Mrs Allpress. Mr Tanaka said Ms Wynne put pressure onto him and he was doing his best to relieve the pressure off Mrs Allpress.

Mr Goodwin played the head-on film and showed Ms Wynne in a position one off the fence with a gap between her mount and Mrs Allpress. Mr Goodwin said that although it was a marginal gap it was a gap which Mr Tanaka took advantage of. The side-on view confirmed there was a gap available for Mr Tanaka to improve into and it would be “expected” that he would improve into this gap. From that point Ms Wynne, when riding with vigour, started to move inwards causing Mr Tanaka to run out of room. She did straighten her mount but by that time the damage had been done. Mrs Allpress, having being tightened on the rail, was forced to check. Mr Goodwin concluded by saying the Stewards believed there was a definite gap for Mr Tanaka to go through, albeit marginal.

Mr Myers played the head-on film of the incident. He said that the gap Mr Tanaka went for was only marginal for 2yr olds. Mr Tanaka made no attempt to stop riding and he “used” Ms Wynne to cut off Mrs Allpress’ mount which was tiring. Mr Myers said TECHNICIAN was a first starter; it was a winter track where horses get tired and move around. If it had been a summer track taking the gap would have been fine. In his opinion Mr Tanaka was equally at fault as Ms Wynne because she stopped riding and pulled her horse off as soon as she realised Mrs Allpress was in trouble. Mr Myers concluded by saying this was a marginal case and he believed a good strong warning would be appropriate.

Ms Wynne said prior to the incident her mount was under a hard ride. She could see that Mrs Allpress was going to drop off but she was unaware of Mr Tanaka coming through so quickly and she got a real surprise when she saw him suddenly appear. 

Reasons for Decision:

The Committee looked very carefully at all the films and had regard to all of the submissions. In our opinion there was a sufficient gap for Mr Tanaka to take between Ms Wynne and Mrs Allpress. We accept the gap was a narrow one but it was sufficient for Mr Tanaka to improve into.

Ms Wynne was, unfortunately, unaware of Mr Tanaka rapidly improving on her inside and allowed her mount to move in under pressure while continuing to ride with vigour. It was only after approximately five strides that she pulled off by which time Mrs Allpress, on the rail, had been forced to check.

Submissions for Penalty:

Mr Goodwin told the hearing that Ms Wynne’s riding record under the careless riding rule was “not good”. He advised of six previous suspensions for the current racing season, adding that she clearly has some issues. The Stewards’ placed today’s breach as in the mid-range of careless riding and called for a term of suspension.

Mr Myers said this was a minor breach of careless riding and asked the Committee to take into account the fact that Ms Wynne had never been charged with careless riding while in the North Island.

Reasons for Penalty:

The Judicial Committee Penalty Guide provides that the starting point for penalties imposed for careless riding is a five day suspension for North Island riders and a three day suspension for South Island riders. The Stewards presented evidence of Ms Wynne being a regular rider in the Central Districts which makes the starting point less clear. On this occasion we adopted a three day starting point and applied aggravating factors.

Ms Wynne has a poor record under the careless riding rule with 6 suspensions in the last 12 months, the most recent being a 3 week suspension incurred on the 23rd April. The Committee was reluctant to impose another lengthy suspension believing Ms Wynne would not benefit from weeks away from raceday riding however her record is a significant aggravating factor and must be reflected in penalty. We placed the degree of interference in the midrange. Ms Wynne did eventually straighten her mount up but it was not an immediate action. The Castletown Stakes is a listed black-type race but we did not apply any uplift in penalty because we did not believe the interference affected any of the stake-bearing placings.

The Committee sought clarification on upcoming riding commitments. Ms Wynne advised of rides at Otago on Sunday June 5th and said any suspension could start after that. The Stewards produced evidence to support the fact that Ms Wynne rides regularly throughput the Central Districts but infrequently in the Northern area.
