As the charge was admitted it was found to be proven. 

Penalty:

Taking into account Mr Riddell's riding engagements he is suspended from the close of racing on Monday 6th June up to and including Friday 10th June. This incorporates the Matamata (8th), South Canterbury (9th) and Counties (10th) meetings.

Charge:

Following Race 4, Mr J Riddell was charged with careless riding under Rule 638(1)(d). The information stated that J Riddell permitted his mount SIMPRE ARRIBA to shift out near the 200m when not clear of DELECTA DREIMS which was checked.

Facts:

 Mr Neal showed the head-on film of the incident which occurred when approaching the 200 metre mark. He stated that Mr Riddell had angled his mount SIMPRE ARRIBA out for a run, and that Mr Riddell continued to angle out into the line of DELECTA DREIMS, ridden by Mrs Allpress who had to take a firm hold of her mount. Mr Neal also noted that there was some inward movement from the horses to the outside of Mrs Allpress, but the stewards alleged the interference suffered by Mrs Allpress’ mount was primarily due to the outwards movement of Mr Riddell’s horse. Using the rear film, Mr Neal pointed out that Mrs Allpress was maintaining a relatively straight line with no pressure being applied to DELECTA DREIMS from the outside, prior to her receiving a check. The film identified that the check to her mount occurred when SIMPRE ARRIBA shifted outwards and crowded DELECTA DREIMS for room. Mr Neal submitted that just after the incident, the outside horse continued to shift in a little, dictating Miss Johnson (THEMONEYZMINE), but that the damage to DELECTA DREIMS had already been done when Mr Riddell came out when not sufficiently clear of Mrs Allpress.
 
Mr Riddell stated that SIMPRE ARRIBA was having its first start and was therefore a little bit green. Consequently, he stated  that he applied some pressure in order to get around the horse in front of his mount at the time. Mr Riddell submitted to the committee that at the moment the interference had occurred, one side of his rein had slipped out of his hand, resulting in SIMPRE ARRIBA moving out a fraction further than he had anticipated, and that it had taken a further stride to get his ride back into line. It was also Mr Riddell’s belief that the movement of horses to the outside of DELECTA DREIMS had not helped the situation, stating that such outside movement would have been equivalent to his own mount’s movement, causing a sandwich situation.
 
In response, Mr Neal stated that riders are obligated to ride with a duty of care, and while the stewards accept that there was outward movement, they believe the check to Mrs Allpress was primarily due to the outward movement of Mr Riddell’s mount.

Submissions for Penalty:

Mr Neal submitted that Mr Riddell’s riding record demonstrated 3 periods of suspension within the last 12 months, and that there had been a significant passage of time since Mr Riddell’s last suspension on 12 February at Awapuni. It was the stewards submission that the level of carelessness was in the low to mid-range and that a period of suspension was warranted. In mitigation,  Mr Neal believed Mr Riddell’s mount had come out and applied pressure to SIMPRE ARRIBA leaving Mrs Allpress in an unfortunate position where she had nowhere to go. He also stated that those riders to the outside of Mrs Allpress had no obligation to create any room for her on this occasion.
In response to a question from the committee, Mr Neal submitted it was the stewards belief that Mr Riddell should be considered as a national rider.
 
Mr Riddell was invited to make submissions on penalty but stated he had no submissions to make. He did confirm that due to riding engagements he would like any period of suspension to commence after the close of racing on Monday 6 June.

Reasons for Penalty:

The committee had regard to all of the submissions put before it. It was our opinion that a period of suspension was an appropriate penalty on this occasion. Mr Riddell was riding competitively, but did not exercise the duty of care that is expected of all riders.  The committee believed the check to DELECTA DREIMS was solely due to the outward movement of Mr Riddell’s mount. While it was apparent that there was movement from those horses positioned to the outside of Mrs Allpress, such movement took place after the interference had already occurred. The committee adopted a starting point for a period of suspension of five days, but in mitigation gave credit to Mr Riddell for his early admission of the breach, and his good riding record. The committee also believed that as a first starter, it was feasible for SIMPRE ARRIBA’s movement to be attributed to one-sided rein-riding near the 200 metre mark, which required Mr Riddell to take action. The committee also considered Mr Riddell as a national rider. For these reasons we placed his carelessness within the low-range and imposed a three day period of suspension.
