--N Goodwin filed an information alleging a breach of Rule 638(1)(d) in that R Myers permitted her mount Henree to shift in over the final stages when not sufficiently clear of Designer Shaik (V Ho) which was tightened and dictated inwards onto Our Jubilee (D Walker) which was tightened and checked
--The rule was read and confirmed.
--Mr Neal gave his interpretation of the incident in Race 6 over the final stages of the race by way of head and side on video. Our Jubilee (D Walker)was down on the inside fence on her quarters was Designer Shaik (V Ho) and 3 wide on the outside Henree (R Myers).
--At approximately the 200m there was a gap for Designer Shaik (Mr Ho) to move into as the field moved on, Mr Ho established himself in the gap after another 50 or so metres, R Myers on Henree slowly drifted in and tighten the line of Designer Shaik, which dictates him into Our Jubilee and D Walker has to restrain his horse short of the line.
--R Myers confirmed the presentation as presented but was unaware V Ho was there initially and did put the whip away and eased off.
--The charge is proven.
--Penalty
Mr Goodwin in summary rated the interference as only minimal and not at the top end of the scale. Both riders affected were only hampered. The gap was there and Mr Ho was entitled to his line. Miss Myers has a record of five suspensions, three in a very short space of time. The Stewards ask for a penalty of suspension of four days.
Decision
The committee have considered all matters in relation to the interference which was deemed at the lower end of the scale, Miss Myers admittance of the breach and her riding record. While the interference was at the lower end, Miss Myers consistency in offending gives the committee reason for concern. While noting the previous four day penalties, the committee on this occasion has the opportunity to offer a greater deterrent and impose a penalty of suspension from the close of racing Sunday 7th February up to and including the close of racing on Sunday 14th February (5 days).
