--N Goodwin filed an information under Rule 632, where the Stewards request a ruling with respect to whether Jacqui’s Bar was denied a fair start.
--Rule 632
If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), the Judicial Committee may declare such horse a non-starter.

--N Goodwin filed an information under Rule 632, where the Stewards request a ruling with respect to whether Jacqui’s Bar was denied a fair start.
--Rule 632
If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), the Judicial Committee may declare such horse a non-starter.
The rule was read and confirmed.
--Mr Goodwin stated Mr Taylor had advised the Stewards immediately on returning to scale he was impeded at the start of the race.
--The video was then shown to all parties of the start of Race 4.
--The committee heard from Mr Taylor that he had hit the horse in the mouth with his hand and the reason for this was his left leg had caught on the starting attendant’s leg and dragged him back in the saddle.
--It was a counter lever affect which threw him off balance; he nearly lost his irons for a good 50-100m, losing several lengths and could not do anything onboard before gaining control.
--When questioned why Mr Buckley was in the stalls, Mr Taylor confirmed Mr Buckley had lead Jacqui’s Bar into the stalls and had hopped up on the side, had hold of reigns and his leg had not got back far enough. Mr Buckley confirmed he had led the horse in, was up laying along the top of the stall as they do with one foot down on the plate and felt Jockey Taylor’s leg as Jacqui’s Bar was being a bit naughty and called to the starter to let them go. At that point Jacqui’s Bar learnt over to his side as the gates opened.
--Mr Buckley stated that in his opinion if the horse had been standing straight it would not have happened. Mr Goodwin stated this was an unusual situation which was confirmed by those present and the Stewards would like it noted that the attendant’s are there to help and this was a fluky situation.
--Decision
In reaching their decision the committee has carefully considered all evidence presented to it by all parties concerned and use of the video coverage provided. It is clear on the video as the gates open by the angled and awkward departure by Jacqui’s Bar that the horse or its rider has been impeded in some manner at the start.
The evidence presented by both Jockey P Taylor and Starters Attendant M Buckley that contact in the manner of the attendants leg on the foot of P Taylor getting hooked and in losing balance his hand has made contact with the horses head. This was consistent and accurate in description as to what was visible on video. P Taylor has struggled to take a hold or control of his mount for 50 to 100m.
--The committee finds Jacqui’s Bar has been denied a fair start and such occurrence materially prejudiced the chances of that horse. Jacqui’s Bar is declared a non-starter.
