 As Ms Dravitzki admitted the breach we found the charge proved.

Penalty:

 Ms Dravitzki is suspended from the close of racing on Tuesday November 5th up to and including racing on Sunday November 10th.  Race days in this period are:

Charge:

Following the running of Race 2, Mickey’s Super Liquor Thanks for the Memories 3YOMDN 1200m, an Information was lodged by Mr N Goodwin alleging a breach of Rule 638(1) (d) in that M Dravitzki allowed her mount MAE WEST to shift out near the 150 metres when not sufficiently clear of TRIPLE BILLING which was checked and dictated into the line of ROSE AND CROWN which was hampered.

Facts:

Mr Goodwin read the rule and Ms Dravitzki said she understood the nature of the charge and confirmed that she admitted the breach. Ms Dravitzki is an apprentice rider and had licensed trainer Mr J Bary to assist her.

The incident happened soon after the field turned into the home straight. Ms Dravitzki was racing in a position about mid-field adjacent to the running rail, but seeking to come wider for clear racing room. Further out was Mr Hannam (ROSE AND CROWN) with Mr Forbes on TRIPLE BILLING attempting to run into a gap between the two. Ms Dravitzki, while riding with some vigour, moved outwards when not clear of TRIPLE BILLING forcing that horse out onto ROSE AND CROWN. Both horses suffered interference with Mr Goodwin saying that no other runners contributed to the incident. The committee asked the stewards to comment on the consequences, through to the end of the race, for the two affected runners. Mr Goodwin said Mr Forbes had informed him that TRIPLE BILLING had raced erratically throughout the race and that Mr Hannam said he did not think he would have finished closer.

Mr Bary concurred with Mr Goodwin’s assessment of the incident and said while it was quite clear that Ms Dravitzki moved into Mr Forbes' rightful line of running TRIPLE BILLING was racing erratically and not travelling very well at the time.

Submissions for Penalty:

Mr Goodwin produced Ms Dravitzki’s riding record which showed the following suspensions:

22/6/13                5 days

28/2/13                4 days

20/12/12              4 days

He said this was a good record considering how busy a rider she is.

In regard to the breach today Mr Goodwin said Ms Dravitzki had not moved out sharply but had allowed her mount to gradually drift outwards and for this reason submitted that it was mid to low range carelessness. The stewards’ submission was for a suspension of 4 days. 

Ms Dravitzki asked the committee to take into account her good record and her admission of the breach. She advised of riding commitments through until Tuesday November 5th and said at this stage of her career she was riding only in the North Island.

Reasons for Penalty:

The committee took into account all of the submissions and adopted, as a starting point, a period of five days suspension. We assessed the degree of carelessness and the consequences to sit at mid range. The rear view film, in particular, was helpful in showing Ms Dravitzki drifting outwards for 5 – 6 strides before she made any attempt to correct her mount. She only straightened once Mr Forbes was squeezed out of the gap and there was general buffeting of all three horses. The committee explained to Ms Dravitzki that she should have taken corrective action much sooner. We have given her credit for her admission of the breach and her good record. Taking into account all of these factors we imposed a 4 day penalty.  We were satisfied, that at this stage of her riding career, Ms Dravitzki rides only across the North Island.
