As Mr Hannam admitted the breach we found the charge proved.

Penalty:

Taking into account upcoming riding commitments Mr Hannam is suspended from the close of racing on Saturday June 7th up to and including racing on Thursday June 12th. Race days in this period are:

9/6/14 Otaki
11/6/14 Avondale
12/4/14 Wanganui

Facts:

Following the running of Race 1, Lowe Schollum & Jones 1200, an Information was lodged by Mr N Goodwin alleging a breach of Rule 638(1) (d) in that rider R Hannam allowed his mount FETCHING to shift in near the 900 metres when insufficiently clear of UNIQUE which was checked.

Mr Tidmarsh showed the video of the race at the 900 metre mark where the incident occurred. Rounding the corner leaving the back straight Mr Hannam was racing on the outside of UNIQUE (K Smith) looking for a position closer in towards the rail. He angled his mount inwards when only one length clear causing a check to UNIQUE which required Mr Smith to take a hold of his mount. Mr Goodwin said there was no pressure on Mr Hannam’s mount from any other runner.

Mr Hannam said he misread the situation and thought he was clear when he moved inwards.

Submissions for Penalty:

Mr Goodwin produced Mr Hannam’s riding record which showed his most recent careless riding charge was in December last year and prior to that he was also suspended in November. Mr Goodwin said this was a very good record especially considering the number of rides Mr Hannam has in a season. He placed the degree of carelessness in the midrange but did comment that UNIQUE was being hunted up at the time and Mr Hannam may not have been aware of this when he elected to move across. The Stewards’ submission was for a five day suspension.

Mr Hannam informed the committee that the busiest riders in the country can have between 500 – 800 rides in a season. He is one of ten riders who fit into this category and he asked us to take this into account when setting penalty. He also reiterated that he made a slight error of judgement and commented that if Mr Smith had taken hold of his horse a stride earlier the incident may have been less serious.

Reasons for Penalty:

In coming to a decision on penalty the committee took into account all of the submissions and adopted as a starting point a period of five days suspension. We gave credit for Mr Hannam’s admission of the breach and his record. Mr Hannam rides extensively throughout the country and two suspensions in 8 months must be considered a very good record. In our opinion the degree of carelessness was in the medium to low range and considered a neutral factor.

Balancing up all the factors it was our opinion that a four day suspension was an appropriate penalty. Mr Hannam advised of riding commitments at Trentham on Saturday June 7th.
