As the charge was admitted, the charge is deemed to be proved. 

Penalty:

Miss Ansell is suspended from the close of racing on Saturday 30 November until the close of racing on Sunday 8 December 2019. 

Facts:

Following the running of Race 1 (Dave Hoskin Carriers Maiden 1340m), Information A11663 was filed with the Judicial Committee. It alleged a breach of Rule 638(1)(d), in that : “...B Ansell allowed her mount SORRY I’M LATE to shift inwards in the home straight when not clear of CARPE DIEM which was checked”.

Rule 638(1)(d) states:

“A Rider shall not ride a horse in a manner which the Judicial Committee considers to be: ... (d) careless.”

Miss Ansell, assisted by Mrs K Clapperton, confirmed that she understood the Rule and admitted the breach.

Using the head-on, side-on and rear-view films Mr D Balcome identified SORRY I’M LATE racing in a position five to six off the fence. From the 200 metres Miss Ansell allowed her mount to drift in, and continued on such a trajectory causing Mr C Johnson, who was positioned behind but to her inside, to check his mount to avoid the heels of Miss Ansell’s horse. Mr Balcombe believed the side-on film identified that SORRY I’M LATE was a bare length clear when moving into Mr Johnson’s line.

Mr Goodwin had spoken with Mr Johnson who said that Miss Ansell had come across without looking, being only one length clear, and that required him to check his mount, albeit minor in nature.

Miss Ansell informed the Committee that she hadn’t realised that she had drifted inwards that far, had been riding for six months and was still learning.

Mrs Clapperton said the apprentice had a good record and her observation was that every time Miss Ansell struck the horse, it continued to gradually move inwards due to reduced control of her hand on the reins.

Submissions for Penalty:

Mr Goodwin identified that this was Miss Ansell’s first charge and that she had 104 rides without a suspension. He submitted the check to Mr Johnson to be minor in nature and believed the carelessness to be below mid-range. He submitted a term of suspension as appropriate.

Miss Ansell advised that any period of suspension could commence straight away and she, nor Mrs Clapperton, had no further submissions to make.

Reasons for Penalty:

The Committee considered all of the submissions placed before it. It is clear that Miss Ansell soon after turning for home was in a position much wider on the track. From that point until the 100 metres, she had drifted inwards to a position much closer to the running rail. In doing so, without looking, she moved into the rightful line of Mr Johnson who was required to check after she was only one length clear. We accept Miss Ansell’s explanation that she was not aware that she had drifted in, which we put down to her riding inexperience. We place the level of carelessness at below mid-range and adopt a starting point of seven days suspension. In mitigation we have considered her very good record, her inexperience and her admission of the breach. On balance we consider a five days period of suspension as appropriate.
