 As the charge was admitted, the committee deem the charge to be proved.

Penalty:

Mr Bradley is suspended from the conclusion of racing on Saturday 10 September until the conclusion of racing on Saturday 24 September. This is a total of four (4) days and incorporates the Wanganui (15th), Hawke’s Bay (17th), Otaki (22nd) and Taranaki (24th) meetings.

Facts:

Following the running of Race 7 (HS DYKE WANGANUI GUINEAS 1340), Information A6845 was filed with the Judicial Committee. It alleged a breach of Rule 638(1)(d) by Licensed Jockey, Mr Darryl Bradley. The Information stated: ”D Bradley angled his mount out near the 600 metres and caused a check to CALLIDORA”

Rule 638(1)(d) states:
“A Rider shall not ride a horse in a manner which the Judicial Committee considers to be: … (d) careless.”

Mr Bradley confirmed to the committee that he understood Rule 638(1)(d), and that he admitted the breach.

Using the available films, Mr Goodwin identified Mr Bradley’s horse (DON BLANCO) racing in the trail behind MANHATTAN STREET (J Riddell). At the 600 metres mark, Mr Bradley had angled his mount out, at which point the pace had eased somewhat. Mr Goodwin believed it was clear that DON BLANCO had been in close proximity to MANHATTAN STREET and as a result of Mr Bradley’s movement, this had caused a check to CALLIDORA (K McCulloch), located to his outside.

Mr Bradley said he had ridden the gelding twice previously, and that DON BLANCO had previously had issues with his racing manners and that it had not got any easier. He accepted that he did have the opportunity to take a hold and as he had not done so, he was taking responsibility for his own actions.

Submissions for Penalty:

In presenting Mr Bradley’s record, Mr Goodwin identified that he had a very good record, having had no breaches of this rule within the last 12 months. Given the degree of carelessness, Mr Goodwin submitted a period of suspension would be appropriate.

Mr Bradley  advised the committee that he had riding engagements up until Saturday 10 September. He stated that he always aimed to be a competitive rider and did his best for connections and the betting public. He stated that it had been some time since he had ridden up North, but had previously ridden at Riccarton, albeit as part of a Premier racing programme.

Reasons for Penalty:

The committee had regard to all of the submissions put before it. The films clearly demonstrate that Mr Bradley was racing in very close proximity to Mr Riddell. Mr Bradley had the opportunity to take a hold of his mount, yet he did not do so. Instead, he directed his mount outwards in circumstances that did not warrant such action at the time. The films also indicate that the consequential check to Mrs McCulloch had been somewhat less than it could have potentially been as a result of Mr Cameron (HIGHLAD) realising that she was in some difficulty and relieving some of the pressure. We independently assessed the level of carelessness to fall just above the mid-range and believed that a period of suspension was an appropriate penalty to impose on this occasion, and adopted the JCA Penalty Guidelines suggested starting point of five days. In mitigation, the committee considered Mr Bradley’s good record and his early admittance of the breach. In aggravation the committee considered that this was a race with Listed status. On balance, it was decided that a four day period of suspension would be appropriate. The committee also consented to a deferment of the suspension in order to allow Mr Bradley to fulfil riding engagements on Saturday 10 September.
